Committee agreed to
refuse Full Planning Permission on the grounds that:-
 

1.       the
application will provide below the policy expectation of 40% of
open space and therefore doesn’t comply with Aberdeenshire
Local Development Plan 2023 Policy P2 Open Space and Access in New
Development; and

 

2.       that by
reason of the site layout there would be a significant encroachment
of development on land that is identified in the Aberdeenshire
Local Development Plan 2023  Appendix 7D
– Settlement Statement  Newmachar
as protected land (P5) which was not justified and the application
would therefore not comply with the Aberdeenshire Local Development
Plan 2023 Appendix 7D - Settlement Statement -
Newmachar.
