It has been agreed between the parties that
the leases will be completed on 31st March 2025. This is in
consideration of an agreement by the Council to provide a rent free
period to the NHS Trusts from and including the 31st March 2025 (to
and including) the 30th June 2025. In any event, rent will become
payable (from and including) 1st July 2025 without deduction. In
the event the NHS Trusts occupy the building prior to the 1st July
2025 rent will be payable from the date of occupation.
The financial impact on Worthing Borough
Council (WBC) for agreeing to the rent/charge free period for the
NHS Trusts combined is as follows:
The maximum amount of income foregone during
the agreed Rent free period (31st March to 30th June 2025) equates
to £174,044 reducing if occupation is taken up by either NHS
Trust earlier than 30th June.
The maximum amount of Service Charges payable
by the Council between 1st April - 30th June 2025 equates to
£75,955 reducing if occupation is taken up by either NHS
Trust earlier than 30th June.
This equates to a total sum of £249,999
As with the rental payments, service charges
payable beyond the sum of £75,955 will be paid accordingly by
the NHS Trusts as per the lease terms.
The above negotiated arrangements are entirely
without prejudice to each party's legal position set out in the
Agreements for Lease and Leases and have been arrived at to enable
the parties to work collaboratively in reaching a solution which
enables the project to progress as envisaged.
