Authority is granted for Legal Services to
execute the required removal of charge form to facilitate the sale
of Plot xx, Summer Lane, Pagham

Reasons for the decision

The Council holds a charge over the land at
Summer Lane, Pagham, and has acquired plots from this development.
A dispute with an adjoining landowner regarding the access road has
been managed through legal negotiations, resulting in an indemnity
agreement. This ensures that, in the event of an adverse ruling,
the developer will realign the road and ditch within their own land
and grant Arun the necessary rights. Given that the final plot
(Plot XX) is now being sold, removing the charge is appropriate and
will not impact the Council’s secured position.

Alternative options considered

The option to retain the charge was considered
but is not necessary given the indemnity agreement in place, which
protects the Council’s interests.
