To instruct legal to prepare a new periodic
licence to document the occupation of the land by Nightingales
Residents Association for the purpose of dog walking and
recreational activities by the residents only.
There are to be no commercial activities to be undertaken on the
land.
To instruct ADC solicitors to prepare, review and complete the
licence.
Reasons for the decision
REASON FOR THE DECISION
This decision is in accordance with our disposal policy, as
documented within ADC Asset Management Strategy.
This site forms part of the Asset Review Working Party and whilst
the aspirations are to undertake a feasibility for development, the
anticipated timeframes for delivering an outcome remain in the
medium to long term due to the complexities of the site.
Having the site occupied during the interim period benefits both
organisations and avoids any potential of adverse possession claims
or unwanted trespassers.
The licence would include adequate break options, be personal to
the association, non-assignable and will include a modest rent of
£100pa payable annually in advance.
Due to the unusual configuration and restricted access to and from
the site makes it incredibly challenging to offer the site to the
market seeking alternative uses or other individuals wishing to use
the land for grazing.
Alternative options considered
a) Leaving the land vacant. Ongoing
risks.
