Content
A decision has been taken to authorise Legal
Services to act on behalf of Housing in its capacity as landowner,
allowing the developer to access Council-owned land at Land South
of Ancton Lane. This access is required in order to deliver a
pedestrian path forming part of off-site highway works associated
with the development.
Reasons for the decision
The developer requires access over ADC land to
deliver the pedestrian route, which forms part of the agreed
off-site works needed to support the development. Legal Services
must be authorised to proceed so they can undertake the required
legal work on behalf of the Council as landowner. This ensures that
access arrangements are properly formalised and compliant with
constitutional requirements.
Alternative options considered
No alternatives were identified in the
document. Access is required to enable delivery of the pedestrian
path, and authorising Legal Services to proceed is necessary for
this to take place.
