Decision
To approve and authorise possession proceedings to recover a property in Ferring, from Mr xx, who is occupying the property as an unauthorised occupant following the death of the former tenant. To instruct Legal Services to take the necessary action to obtain possession of the property.
Reasons for the decision
Mr xx has no legal or discretionary right to remain in the property following the refusal of both his statutory succession application and discretionary succession request. A valid Notice to Quit has been served and expired. The Council has considered the circumstances of the occupier, including known vulnerabilities, and has provided repeated opportunities and support to engage with Housing Options and secure alternative accommodation. Significant concerns have arisen in relation to anti-social behaviour, substantial use and occupation arrears, failure to provide access for statutory gas safety inspections, poor property condition and the Council's need to recover the property to meet its housing management duties. The Council concluded that possession action is lawful, reasonable and proportionate.
Alternative options considered
• Allowing Mr xx to remain in occupation was considered and rejected as he has no legal entitlement to the property.
• Delaying possession proceedings to allow further engagement was considered; however, extensive support, referrals and opportunities to engage had already been provided over a prolonged period without meaningful progress.
• Rehousing options were explored through referrals and signposting to Housing Options, but the occupier failed to engage fully with the process or provide the necessary documentation.
