Purpose

Requesting approval consideration for the First Registration of Riverbed within the central Pulteney stretch.

Decision

The Cabinet Member approves the first registration of land aligned with the council’s existing riparian interests.

Reasons for the decision

This activity will improve the council’s ability to manage the cities central waterway and effectively focus its resources, through defining the extent of council responsibilities.

Through subsequent implementation of other associated projects, this activity will also ensure that the council can preserve public safety in the area, support healthier river environments, and limit its own corporate liabilities.

Alternative options considered

Option 1 – Leave the riverbed as is, with the presumed council riparian ownership of all of the riverbed to at least the half way point. (Not Recommended).

Option 2 – Apply to HM Land Registry for all riverbed within the Pulteney stretch associated with council land, plus liaise with other owners in areas of interest to explore interest in land transfers. This will enable the council to claim ownership of the riverbed throughout the entire Pulteney stretch. (Not Recommended).
