Purpose

The Council intends to undertake a restricted tender process via the Chest Procurement Portal for the resurfacing and improvement works to sections of the Public Rights of Way network as part of the Destination Darwen project.

Decision

DECISIONS:

1)    That it be noted that the proposed works would take place on land within or adjacent to the boundary of an existing road and as such it be  considered to be permitted development under Schedule 2 of the General Permitted Development Order 2015 (as amended), Part 9, Class A “development by highway authorities” (as amended)

2)    That the procurement strategy for the proposed tender to obtain prices for the scheme be approved, and that it be noted that a future report would be considered by the Executive Board to appoint the contractor.

3)    That authority be delegated to the Growth Programme Director to agree the final tender list following submission of expressions of interest from suitably qualified and experienced contractors.

REASON FOR DECISION:

To enable improvement works to proceed on the Public Rights of Way network, with funding allocated from the Darwen Town Deal.

OTHER OPTIONS CONSIDERED AND REJECTED:

A competitive procurement exercise via the chest is the most viable option for this project.
