Decision
1) To accept the surrender of the Lease dated 19th April 2024 with effect from 31st July 2025 from Tower Cinemas (Blackpool Ltd).
2) To proceed with the Management Agreement with Arc Cinema Ltd, on an interim basis for a period of up to three months and to agree that the Council will underwrite all costs during this time including staffing, any redundancies, suppliers, consultants together with the monthly management fees.
3) To delegate authority to the Chief Executive, after consultation with the Leader of the Council, to enter into a Lease with Arc Cinema Ltd subject to satisfactory due diligence and within existing financial limits.
4) To enter into/accept the transfer of a Premises and Alcohol Licence and any other
contracts/supplies as necessary for the cinema operations, on an interim basis to the Council, and to transfer the same to Arc Cinema Ltd as required when the Lease is completed.
5) To delegate authority to the Chief Executive, after consultation with the Leader of the Council to enter into leases for the restaurant subject to satisfactory due diligence and within existing financial limits.
6) If resolution 1 cannot be completed as it requires the co-operation of the current
Tenant, then to delegate to the Chief Executive the decision to instruct the Head of Legal Services to forfeit the Lease dated 19th April 2024.
7) To authorise the Head of Legal Services to prepare legal documentation and enter into and complete appropriate documents/contracts as necessary to complete the transactions after due diligence is completed.
