Exemption from publication: There are
confidential appendices to this report, which are exempt by virtue
of paragraph 3 of Schedule 12A of Part 1 of Schedule 12a of the
Local Government Act 1972 because they contain information relating
to the financial or business affairs of any person (including the
authority holding that information).

To renew lease regarding EE & H3G Ltd. (EEH3G),
Telecommunications Installation at Wycombe Badminton Centre, Crest
Road, HP11 1UA.

Reasons for the decision

On the 17th July 2002 the Council granted a
Lease to Hutchison 3G UK Limited in regards telecommunications
equipment (mast) installation at Wycombe Badminton Centre, Crest
Road, HP11 1UA.
This Lease expired on the 31st December 2021 and EEH3G have been
holding over on existing terms, since then.

EEH3G have recently served notice on the Council seeking the
renewal of lease.

Heads of Terms (HoTs) have been agreed with EEH3G in regards a
lease renewal. The agreed HoTs are contained within the
confidential appendix.

Alternative options considered

If the Council does not proceed with proposed
renewal it runs the risk of the Operator taking matter to Tribunal
and lease terms being imposed in the Council by said
Tribunal.
