Purpose

During Autumn 2025, following legal advice and
confirmation from the MO and s151 Officer, we are no longer
required to complete a report for the Children & Families
Committee and a published ODR for each conversion/transfer.
The revised process is:
* Strategic Project Manager Education complete an ODR
(non-published) for Commercial Transfer Agreement.
* Property Services Manager complete ODR (non-published) for land
transfer.
* Strategic Project Manager Education provide a regular summary
report to Democratic Services to share with the C&F Committee
members.

The ODR will note consultation with Headteachers and Chair of
Governors through the DfE led project meetings, which are held for
each conversion/transfer.

To enter into a Commercial Transfer Agreement with Halliard Trust,
in substantially the same standard form as required by the
Department for Education on the conversion of Alderley Edge
Community Primary School, Church Lane, Alderley Edge, Cheshire SK9
7UZ.
The DfE has made an Academy Order dated 15 May 2025 that Alderley
Edge Community Primary School converts to an Academy.

Halliard Trust, The Fallibroome Academy, Priory Lane, Macclesfield,
SK10 4AF, was established on 16 August 2010. It currently has eight
Cheshire East Primary academies, two Cheshire East Secondary
academies and one Cheshire West and Chester Secondary Academy. The
Halliard Trust is governed by its Board of Trustees. The Trustees
are the legal governors of the Trust and the directors of the
charitable company and are responsible for the operation and
performance of all schools in the Trust.

The proposed conversion date is 1 April 2026.

The Council is entering into a Commercial Transfer Agreement with
the Governing Body of Alderley Edge Community Primary School and
Halliard Trust to give effect to this conversion. This agreement
deals with transfer of non-land assets, contracts, staffing and
information.
