Purpose

To approve the terms of settlement in respect of the compulsory acquisition of land required for the Middlewich Eastern Bypass (the permanent land take area, comprising CPO Plots 21a, 21b and 21c, General Vesting Declaration (No 3) served on 9 June 2026); and to authorise the Council to: (i) pay the agreed compensation for the permanent land take and for the service media diversion works undertaken by the Owner; (ii) transfer back to the Owner the land vested under the CPO that is surplus to the Scheme’s permanent requirements (the “Handback Land”); (iii) take and reserve the rights required by the Council over the Handback Land; and (iv) take a lease of the Temporary Land Take Area for construction working areas. To enter into a Settlement Agreement and any ancillary agreements in connection with the above, and to pay the Owner’s reasonable and proper professional fees, on terms and conditions to be agreed by the Head of Estates and the Director of Law & Governance, in full and final settlement of the Owner’s compensation claim.
