Report

Council, with a view to ensuring that, for each asset, the future
use and ownership reflect the most appropriate solution for the
Council and communities as set out in the report.

DECISION:
RESOLVED:
1.
That Cabinet approves the development of a
programme: the ambition and purpose of which is to review the
environmental assets held by the Council with a view to ensuring
that for each asset the future use and ownership reflect the most
appropriate solution for the Council and communities having regard
to, amongst other things, the issues identified in the
report.
2.
That authority be granted to the Strategic Director
with responsibility for the asset to transfer it to the most
appropriate recipient, whether one of the Council’s owned and
controlled entities or otherwise, subject to:
(i)
Consultation with the Section 151 Officer and the
Monitoring Officer, or their respective nominees,
(ii)
Consultation with the Portfolio Holder for Resources
and, as appropriate, the Portfolio Holder for Environment and
Climate Change or Portfolio Holder for Neighbourhoods,
(iii)
Appropriate due diligence in relation to the
proposed recipient to ensure they are in a position to take on and
maintain the asset in question,
(iv)
The Strategic Director with responsibility for the
asset being satisfied that the benefits in transferring a
particular asset outweigh the benefits of the Council retaining
it,
(v)
Disposals being by the most appropriate means, such
as freehold transfer, lease or licence,
(vi)
Compliance with the relevant Council policies and
procedures, including the Code of Practice for Land and Property
Transactions, subject to recommendation 2(iv).
