the River Camel SAC and setting up a Nutrient Credit
Scheme.

DECISION:
 

RESOLVED: 
 
1. 
That authority be delegated to the Strategic
Director for Sustainable Growth and Development, who may onward
delegate to an appropriate Service Director, to set up a Cornwall
Council Mitigation Scheme and to allocate mitigation credits in
accordance with a credit allocation scheme in line with the
principles set out in this report, in consultation with the
Portfolio Holder for Planning and Housing, and the Section 151
Officer and the Monitoring Officer, and furthermore to allocate
funds from the Community Infrastructure Levy as required in
accordance the CIL Strategic Programme.
2. 
That any costs recovered from selling credits be
returned to the Community Infrastructure Levy budget up to the
amount utilised from that budget and any further costs recovered to
be retained for other future nutrient neutrality mitigations in
accordance with the Department for Levelling Up, Housing and
Communities capital funding memorandum of understanding.
3. 
That authority be delegated to the Strategic
Director for Sustainable Growth and Development, in consultation
with the Portfolio Holder for Planning and Housing, the Section 151
Officer and the Monitoring Officer, to agree terms to secure
strategic mitigations. Where this involves property or asset
acquisition, endorsement from the Service Director for Assets,
Capital and Commercial Services shall also be obtained.
4. 
That the setting up of an approved contractor(s)
list for replacement septic tanks by delegated to the Strategic
Director for Sustainable Growth and Development, and for the
mitigation secured as a result to be administered in accordance
with any Cornwall Council credit scheme.
 

RESOLVED TO RECOMMEND TO COUNCIL:
 
1. 
To approve the capital uplift of £998,380,
funded by the Community Infrastructure Levy.
