Purpose
To confirm approval to award a
concession contract for environmental enforcement services to
Kingdom L A Support Ltd via direct award via a compliant framework.
The contract will enable the Council to tackle littering,
fly-tipping, and breaches of Public Space Protection Orders (PSPOs)
across Crawley. The service will operate at no upfront cost to the
Council, funded through Fixed Penalty Notice (FPN) revenue, and
includes strong performance, legal, and financial safeguards.
Crawley Borough Council has a statutory duty to maintain clean and
safe public spaces, but there is no statutory requirement to
deliver enforcement activity against littering offences.
Environmental crime, such as littering, fly-tipping, graffiti, and
PSPO breaches, have increased significantly, impacting community
pride, public health and safety. Complaints from residents have
risen, and failure to act risks:
• Breach of Environmental Protection Act 1990 (littering and
waste offences).
• Breach of Anti-Social Behaviour, Crime and Policing Act 2014
(PSPO enforcement).
• Reputational damage and loss of public confidence.
Current in-house enforcement capacity does not meet the required
levels to effectively tackle the increasing problem of
environmental crime across Crawley. This concession contract will
provide additional resources, which can be mobilised at pace, for
non-statutory enforcement activity.
Littering and fly-tipping hotspots in parks, town centre, and
residential areas are increasing year-on-year: in addition to the
environmental impact it has an impact on the council’s
Neighbourhood Services capacity for street cleansing and clearance.
The prevalence of environmental crime is also decreasing the
capacity of Community Protection Team to focus on patrolling to
address and deter instances of anti-social behaviour in parks and
open spaces.
The Council will award a concession contract to a specialist
enforcement provider to deliver environmental enforcement services
at no upfront cost. Under this arrangement, the provider will fund
all operational activities through revenue generated from Fixed
Penalty Notices (FPNs). Once the provider has recovered its costs,
fifty percent of any surplus revenue will be paid to the Council.
This model ensures rapid mobilisation, with services commencing
within weeks, and offers financial neutrality for the Council while
maintaining high professional standards through key performance
indicators and robust contractual safeguards.
The contract will run for an initial period of eighteen months,
with an automatic twelve-month extension unless terminated earlier.
Enforcement operations will be delivered between 8am and 8pm, 364
days per year, by a minimum of five full-time enforcement officers
providing 187.5 patrol hours weekly. The provider will supply
handheld devices for real-time FPN tracking and reporting, and the
Council will have full access to enforcement data and audit rights
to ensure transparency and accountability.
Financially, the provider will retain all revenue until the cost
recovery point is reached. After this, fifty percent of any surplus
revenue will be returned to the Council. Performance will be
managed through clear KPIs covering patrol hours, complaint
handling, compliance with Council enforcement policy, and public
satisfaction. Quarterly performance reports and annual revenue
reconciliations will provide ongoing oversight.
Legal safeguards are embedded within the agreement, including full
indemnities for tax, employment, and data protection liabilities,
compliance with TUPE regulations for any staff transfers, and
comprehensive insurance cover of £10 million for employer and
public liability and £1 million for professional indemnity.
Exit provisions require the provider to assist with ongoing
prosecutions after the contract ends and to complete a detailed
handover, including full data transfer obligations. The contract award is through a compliant
framework agreement, awarded in accordance with the Public
Contracts Regulations 2015. The
framework is via Procure Public which permits direct award to the
supplier ranked first, which is Kingdom LA Support.
This approach will deliver cleaner and safer public spaces, a
cost-neutral enforcement model with potential income for the
Council, improved public confidence in enforcement, and social
value through local employment and adherence to the Council’s
Social Value Charter.
N.B: The technical information

Alternative options considered
In house service delivery will incur
substantial upfront set up and technological costs and coupled with
the time taken to recruit and train the required staff, will result
in a significant delay of mobilisation when compared with the award
of the concession contract and was therefore rejected.
