Minor Changes to the Constitution: Disturbance by the Public

Purpose
That the Head of Law and Governance
(previously known as the Head of Governance, People &
Performance) approve some minor changes to the Constitution to
clarify who has authority to make decisions in respect of matters
of order during Council meetings which are held in
public.
Content
That the following bullet point be added to
Paragraph 17.1 of the Full Council Procedure Rules, Paragraph 18.1
of the General Committee Procedure Rules and Paragraph 21.1 of the
Scrutiny Procedure Rules:
"e) The decision in respect of matters of order shall be upon the
advice of the Monitoring Officer (or those officers that the
Monitoring Officer has a delegated the relevant authority
to).”
This change takes immediate effect and the Constitution will be
amended when it is next updated.
Alternative options considered
Option 1 - to keep the Constitution the same
which leaves ambiguity and does not reflect who holds
responsibility when there is a disturbance by the public
Option 2 - update the Constitution to provide clarity
