REASON FOR DECISION AND ALTERNATIVE OPTIONS
CONSIDERED AND REJECTED:
To ensure provision is in place such that the gas systems are
maintained operational once the current contract expires on 31
March 2019. Thereby protecting lift and property and risk of legal
action against the Council.
Content
To go out to tender for a four year contract
(as recommended by Procurement) for the provision of service and
maintenance of the gas flares, associated equipment and gas field
management at the Council’s closed landfills. To include the
services of holder of a Certificate of Technical Competence (COTC)
codes G or M to provide
advice with respect to closed landfills. Estimated cost is
£15k per year, therefore cost for a 4 year provision is circa
£60k. Budget of £45,540.00 provision is in place on a
yearly basis.

Alternatives considered
Do not maintain the systems. Landfills generate both methane and
carbon dioxide; methane is flammable and explosive and also a major
climate change gas; whilst carbon dioxide is an asphyxiant. Without
control measures these gases can migrate beyond the site boundaries
and adversely affect surrounding premises.
Should the Council fail in its control of Pastures Road prosecution
proceedings can be taken by the Environment Agency either in the
Magistrates’ Court or in the Crown Court.
There is also a risk of criminal and or civil action if residential
properties are affected by an explosion or other hazard caused by
the gases or leachate. The Council could face a prosecution under
