Recommendation A (25/2796/MA):
Resolved that Planning
Permission be GRANTED for an application submitted
under Section 73 of the Town and Country Planning Act 1990 for a
minor material amendment in connection with the planning permission
ref. 22/3782/MA dated 17 March 2023 to vary Condition 2; Condition
14; Condition 16; Condition 18; Condition 26; Condition 27;
Condition 28 and Condition 62 to allow for the
following:
-
Amendment to unit numbers to increase the number of
homes provided in Plot 1;
- Amendments to
housing mix;
- Amendments to
design codes and to the approved ground floor and proposed vertical
limits of deviation from AOD parameter plans
- Amendments to
play provision.”
Consent subject to:
(i)
The receipt of the Council’s FVA
consultant’s assessment confirming that the development
cannot yield a higher percentage of Affordable Housing than is
currently agreed;
(ii)
The satisfactory completion of a Deed of Variation
to the Section 106 (S106) Legal Agreement (obligations set out in
Section 21); and
(iii)
Conditions set out in Appendix 2 and any
addendums.
That the Assistant Director
(Planning & Building Control) be authorised to:
(i)
Make any minor changes to the detailed wording of
the recommended conditions as set out in the report (Appendix 2),
its addendums and the minutes of this Planning Board meeting, where
the Assistant Director (Planning & Building Control) considers
it appropriate, before issuing the final decision notice
(ii)
Finalise the detailed terms of the Deed of Variation
to the section 106 agreement (including appended documents) and
form of the planning obligations as set out in this report (Section
21), its addendums and the minutes of this Planning Board
meeting
(iii)
Consider, in the event that the Section 106
Agreement is not completed within three (3) months of the date of
this Planning Board resolution, whether consent should be refused
on the grounds that the agreement has not been completed within the
appropriate timescale, and that the proposals are unacceptable in
the absence of the recommended planning obligations; and if the
Assistant Director (Planning & Building Control) considers it
appropriate, to determine the application with reasons for refusal
which will include the following:

In the absence of a Deed of Variation to the legal
agreement to secure the necessary obligations regarding health
infrastructure, transport, employment and training, the development
would fail to mitigate its impact on local services, amenities and
infrastructure, environmental sustainability and open space
contrary to policies S2, T2, T4,
T9 and DF1 of the London Plan (2021) and EA(c), E1, IM1, IM4 and
IM(b) of the Royal Greenwich Local Plan: Core Strategy with
Detailed Policies (Adopted July 2014), and the Planning Obligations
(s106) Guidance SPD (July 2015).
Recommendation B (25/2975/NM):
That the non-material
amendments be approved for an application submitted under Section
96a of the Town and Country Planning Act 1990 for a nonmaterial
amendment to vary the planning conditions in connection with the
approved reserved matters application ref. 24/1565/R dated 14
November 2024 to allow for the following design changes:
• Amendments to
the building heights and elevation treatments;
• Amendments to
the car parking spaces and the cycle and refuse
strategy;
• Amendments to
the internal layouts; and,
• Amendments to
landscaping.”
