In reaching its
decision, the Licensing Sub-Committee (“LSC”)
considered the Council’s Statement of Licensing Policy, the
Licensing Act 2003, the Regulations made thereunder, and the
Guidance issued by the Secretary of State under S.182 of that Act.
In discharging its functions, the LSC did so with a view to
promoting the licensing objectives of the prevention of crime and
disorder, public safety, the prevention of public nuisance and the
protection of children from harm.
Having considered all
written representations, evidence, and oral submissions, the LSC
resolved to grant a premises licence.
Permitted Licensable Activities:-
Late
Night Refreshment:
Monday to Sunday from
23:00 hours until 23:30 hours.
Non-Standard
Timings: Christmas Eve, Christmas Day,
New Year's Eve and New Years' Day: 23:00 until 00:30 the following
day.
Supply of Alcohol (On the premises Only):
Monday to Sunday from
11:00 hours until 23:00 hours.
Non-Standard Timings:
Christmas Eve, Christmas Day, New Year's Eve and New Years' Day:
11:00 until 00:30 the following day.
Live
Music (On the premises Only):
Monday to Saturday

The
Premises Licence shall be subject to the following
conditions:
The premises licence
holder shall install and maintain a comprehensive CCTV system to
the satisfaction of the responsible authorities. Licensable
activity areas will be covered by the CCTV system including payment
areas, ingress, and egress points. Where practicable frontal
identification of patrons will be captured. The CCTV system shall
record whilst the premises are open for licensable activities and
during all times when customers remain on the premises. All
recordings shall be stored for a minimum period of 31 days with a
date and time stamp and will be made available upon reasonable
request to the registered authorities.
A staff member from
the premises who is conversant with the operation of the CCTV
system shall be on the premises at all
times when the premises are open to the public. This staff
member must be able to show a Police or authorised council officer
(as defined by Section 13 of the Licensing Act 2003) recent data or
footage with the absolute minimum of delay when
requested.
When the CCTV is not
operating, no supply of alcohol shall be made on the
premises.
The smoking area must
be covered by CCTV that is to the same standards as the internal
CCTV system.
The premises licence
holder (or a representative thereof) shall perform regular
maintenance of the CCTV as instructed by the manufacturers’
guidelines and recommended timeframe as a minimum. All cameras
shall be kept clean and clear of obstructions and signage,
including seasonal displays.
A ‘Challenge
25’ proof of age scheme shall be operated at the premises.
Notices shall be displayed inside the premises stating that a
“Challenge 25” policy is in force and the following
forms of identification are acceptable under the scheme: photo
driving licence, passport. Proof of Age Standards Scheme (PASS)
card, military ID and any other locally or nationally approved form
of identification.
A record shall be kept
detailing all refused sales of alcohol. The record should include
the date and time of the refused sale and the name of the member of
staff who refused the sale. The record shall be
available for inspection at the premises by the police or an
authorised officer of the Council at all times whilst the
premises is open.
All windows and doors
must be kept shut whilst regulated entertainment is in progress
except for the immediate entrance/egress of patrons.
Notices shall be
prominently displayed at all exits requesting patrons to respect
the needs of local residents and
businesses and leave the area quietly.

No waste or recyclable
materials, including bottles, shall be moved, removed from or
placed in outside areas between 23.00 hours and 08.00 hours on the
following day.
There shall be a
personal licence holder on duty on the premises between 21:00 hours
until at least 15 minutes after the end time that the premises are
authorised to sell alcohol, or all members of the public have left
the premises - whichever is the latter.
No super-strength
beer, lagers, ciders or spirit mixtures of 6.5% ABV (alcohol by
volume) or above shall be sold at the premises, except for premium
beers and ciders supplied in glass bottles.
The premises licence
holder shall maintain a Register of all employees, including
relatives, working at the premises. The register shall be made
available upon demand to a Police officer, an immigration officer,
or an authorised officer of the Licensing Authority. The Register
of Employees shall record the following information for each
employee:
Full name of
employee;
A copy of the Passport
photograph page or National Identity Card photograph;
Date employment
commenced;
Date employment
ended;
Eligibility to work in
the UK by inspection of passport and originals of the right to work
in the UK documents;
Evidence of the right
to work in the UK;
Signature of the
Premises Licence Holder or DPS to confirm the documents inspected
and date of inspection;
Signature of employee
to confirm documents inspected by the licence holder and date of
inspection
The employee's
residential address.
15. The Premises
Licence Holder and/or Designated Premises Supervisor shall keep up
to date policies and staff training records in relation to the
following: Requirements of the Challenge 25 & PASS ID schemes,
drugs, identification & recognition of intoxicated persons,
responsibilities of dealing with vulnerable persons and associated
schemes (e.g. Ask Angela/WAVE), the correct procedures to be
followed when refusing sale or supply of alcohol, and
incident/accident scene management. Training shall be provided to
all staff no later than every six months, and a record of each
training session shall be maintained for at least twelve months
following delivery, and made available
to authorised officers on request.
16. A log of all staff
suitably trained and authorised by the DPS for the sale and supply
of alcohol shall be kept at the premises, along with a note of
which staff members are in receipt of a personal licence and be
made available to authorised officers on request.
17. In the event of a
crime or incident of disorder taking place on the premises, the DPS
or appointed staff member at the Premises shall call the emergency
services.
18. An incident log
shall be kept at the premises, and made available on request to an
authorised Local Authority or Police Officer, which will record the
following:
All crimes reported to the venue
All ejections of patrons
Any complaints received
Any incidents of disorder
All seizure of drugs or offensive weapons
Any faults in the CCTV
system, or searching equipment, or scanning equipment.
An entry shall be made
every fourteen (14) days as a minimum, confirming a successful test
of the CCTV system, with details of the staff member also
recorded.
Any refusal of the sale of alcohol
Any visit by a relevant authority or emergency
service
All entries shall
record, as a minimum, the date and time of the refusal, details of
the product, and the employee who refused the sale.
19.“It’s A Crime!” notices (or similar) shall be
displayed inside the premises stating that it is an offence for any
person under 18 years of age to purchase alcohol, or for it to be
purchased on their behalf by a person over 18.
20.All
staff shall also receive customer welfare and vulnerability
training from an appropriately qualified trainer, details of which
must be documented (e.g., ‘WAVE’, ‘Ask for
Angela’, or similar). Furthermore, the premises licence
holder (or a representative thereof) shall sign-up to the Royal
Borough of Greenwich Women’s Charter, or its equivalent, and
display certification of this prominently at the
premises.
21.The
premises will be clear of all customers no later than thirty (30)
minutes after the terminal time for licensable
activities.
22.The
Premises Licence holder shall implement a Policy of turning down
the music to a background level and turning on the lights 30
minutes before the end of the hours permitted for licensable
activities to assist in patrons leaving the premises
quietly.
23.Unaccompanied children are not permitted on the premises other
than for safeguarding purposes, where staff shall record the exact
reasons for the child being present and as soon as practicably
possible report to the police the presence of the unaccompanied
child via 101 or 999 dependant on the
nature of their ingress to the premises.
24.All
children under the age of 18 must be accompanied by an
adult.
25.No
children shall be permitted to remain on the premises after 21:00
hours other than for safeguarding purposes.
26.Regular checks of public toilets shall be undertaken as
determined on a risk-assessed basis by the management.
27.The
smoking area at the rear of the premises shall be closed to the
public from 22:00 hours until the opening hours of the following
day. No drinks or alcohol shall be permitted in the smoking
area.
Basis
of Decision
The LSC noted that
all of the licence conditions proposed
by the Police had been accepted and agreed by the
Applicant.
The LSC noted that
there were no written representations from Responsible Authorities,
including environmental health, with the concerns of the police
having been met by the agreed conditions.
The written
representations of the residents were fully considered by the LSC,
in the absence of the residents from the hearing.
The LSC noted that the
concerns of the residents regarding crime and disorder and public
nuisance were concerns regarding anticipated problems that may
arise from the grant of the licence for alcohol and regulated
entertainment. The premises have not previously been operating as a
public house or a bar and there is no history of the premises being
associated with crime and disorder and public nuisance.
The applicant had been
operating a different business from the premises for 20 years and
demonstrated a commitment to promoting the licensing objectives, is the
holder of a personal licence and there has been no objection to the
applicant being the designated premises supervisor.
Whilst the LSC
discussed the applicant’s experience in managing a pub or a
similar business, the LSC note the extensive conditions which will
apply to the licence and which will promote the licensing
objectives and ensure the effective running of the
micro-pub. The LSC noted that the
business is to be family run and members of the family do have
experience of working within a public house and the nature of the
patrons and potential problem that may arise requiring sensitive
and effective action to resolve.
The LSC noted the
concerns regarding parking within the vicinity, however,
availability of parking is not with in the remit of the LSC when
considering the promotion of the licensing objectives.
The LSC noted that the
premises are within a Cumulative Impact Zone. In reaching its
decision the LSC were of the view that the premises are at the edge
of the CIZ and the proposed use of the premises, together with the
conditions imposed on the premises licence, will not
adversely impact upon the licensing objectives.
Condition 27 of the
licence has been modified in respect of the smoking area, which
shall be closed at 10pm and no drinks or alcohol is to be permitted
in the smoking area.
Any party aggrieved by
the decision of the LSC may appeal to the magistrates’ court
within 21 days.
