Purpose

Penalties) (England) Regulations 2023 and introduce a reward scheme
for the provision of evidence on environmental crimes.

1.       Approved an increase
in the Fixed Penalty Notice (FPN) amount for fly-tipping (Section
33(1)(a), Environmental Protection Act 1990) from £400 to
£1,000 and from £300 to £450 if paid within 10
days.
 

2.       Approved an increase
in the FPN for breaches of the household waste duty of care
(Section 34(2A), Environmental Protection Act 1990) from £400
to £600 and from £200 to £240 if paid within 10
days.
 

3.       Approved that the
revised penalty levels will come into effect on 19 January 2026 to
allow sufficient time for updates to internal systems, staff
training, and the changes to be communicated.
 

4.       Approved the
introduction of an Environmental Crime Reward Scheme, with rewards
capped at £100 per qualifying incident.
 

5.       Approved the draft
Public Realm Rewards Scheme Terms and Conditions as set out in
Appendix 1.
 

6.       Authorised the
Director of Communities, Environment and Central to keep the scheme
under constant review and amend and update as appropriate
