The Licensing Sub-Committee determined to grant the application as applied for, subject to the mandatory conditions prescribed by the Licensing Act 2003 and the conditions consistent with the operating schedule submitted with the application.

The licence is granted in the terms applied for.

Reasons for the Decision

In reaching its decision, the Licensing Sub-Committee carefully considered:

• the application and accompanying operating schedule;
• the Licensing Officer's report;
• the written and oral representations made by the applicant’s representative;
• the written and oral representations made by interested parties;
• the Council's Statement of Licensing Policy;
• the Secretary of State's Guidance issued under section 182 of the Licensing Act 2003; and
• the four licensing objectives.

The Sub-Committee was satisfied that the applicant had demonstrated an understanding of the responsibilities associated with holding a premises licence and had proposed appropriate measures within the operating schedule to promote the licensing objectives.

The Sub-Committee noted that the application principally related to the operation of a café with an external seating area and that the licensable activities sought were proportionate to the nature of the business.

Having considered all the evidence before it, the Sub-Committee was satisfied that there was insufficient evidence to conclude that granting the application would undermine any of the licensing objectives. Whilst concerns were raised by those making representations, the Sub-Committee was satisfied that these concerns could be adequately addressed through the measures contained within the operating schedule together with the mandatory conditions attaching to the licence.

The Sub-Committee considered that refusal of the application would not be appropriate or proportionate in the circumstances. The Committee was satisfied that the grant of the licence, as applied for, represented an appropriate and proportionate determination having regard to the evidence before it and the promotion of the licensing objectives.

This decision does not take effect until the expiry of the period for appealing against the decision.

Any party to the hearing who is aggrieved by this decision may appeal to the Magistrates' Court within 21 days beginning with the day on which notification of this decision is given, in accordance with Schedule 5 to the Licensing Act 2003.
