Content
Resolved that it be noted that
the applicant had submitted an appeal to the
Planning Inspectorate on the grounds of
non-determination.
That it be noted the Council
may no longer determine the application as the decision-making
jurisdiction has transfers to the Secretary of State (or to one of
their Inspectors acting on their behalf). However, that the Council is still required to
resolve whether it would have been minded to
grant or refuse the application if the appeal had not been
lodged.
It was resolved that, if the
Committee had the power to determine the application, they would
Refuse consent for the change of use from Use Class E unit
to an Adult Gaming Centre (AGC) (Sui Generis). The reason for
refusal is as follows:
The
proposed development, by way of the over concentration of betting
shops and other associated gambling establishments, would lead to
an unacceptable impact on the amenity of Eltham Town
Centre and lead to an unacceptable increase in anti-social
behaviour. The proposal would therefore fail to be in accordance
with Chapter 7 and 8 of the National Planning Policy Framework
(2023), SD6 and HC6 of he adopted London Plan (2021) and DH1, TC(b)
and CH1 of the adopted Royal Greenwich Local Plan: Core Strategy
with Detailed Policies (2014).
