In
reaching its decision, the Licensing Sub-Committee
(“LSC”) considered the Council’s Statement of
Licensing Policy, the Licensing Act 2003, the Regulations made
thereunder, and the Guidance issued by the Secretary of State under
S.182 of that Act. In discharging its functions, the LSC did so
with a view to promoting the licensing objectives of the prevention
of crime and disorder, public safety, the prevention of public
nuisance and the protection of children from harm. 
 
Having considered all written representations, evidence, and
oral submissions, and the Applicant withdrawing the application for
sale of alcohol for consumption off the premises, the LSC resolved
to grant the premises licence for the sale and supply of alcohol
for consumption on the premises only.
 
 
Permitted
Hours for Licensable Activities:
 
Monday
– Sunday from Midday to 11pm.
 
 
 
The
Premises Licence shall be subject to the following conditions :-
 
1.
An incident shall be kept at the premises and made available on
request to an authorised officer of the council or the police. It
must be completed within 24 hours of the incident and will record
the following:
a) all
crimes reported to the venue;
b)
ejections of patrons;
c) any
complaints received;
d) any
incidents of disorder;
e) all
seizures of drugs or offensive weapons;
f) any
faults in CCTV System. searching equipment or scanning 
equipment;
g) any
refusal of the sale of alcohol date, time and name of Staff;
h) any
visit by a relevant authority or service.
 
2. A
record shall be kept detailing all refused sales of alcohol. The
record should include the date and time of the refused sale and
signed by the member of staff who refused the sale. The record
shall be available for inspection at the
premises by the police or an authorised officer of the council at
all times whilst the premises is open.
 
3.
The premises shall install and maintain a comprehensive CCTV
System. All entry and exit points must covered enabling frontal
identification of every person entering in any light condition. The
CCTV system shall continually record whilst the premises are open.
All recordings shall be stored for a minimum period of 31 days with
date and time stamping. Viewing of recordings shall be made
available immediately upon the request of police or authorised
officer of the council.
 
4. A
staff member from the premises who is conversant with the operation
of the CCTV system shall be present in the
premises at all times when the premises is open. This staff
member must able to provide a police or
authorised Council Officer copies of recent CCTV images or data
with the absolute minimum of delay when requested and within a
maximum of 24 hours of the initial request.
 
5.
Any CCTV breakdown or system failure shall be notified in writing
to the Police and Licensing Authority immediately. Licensable
activities shall cease until the CCTV system is repaired and
operational. The Police or Licensing Authority may in writing
permit licensable activities to continue pending repairs to the
CCTV system.
 
6.
Notices shall be prominently displayed within the premises stating
that CCTV is in operation.
 
7.
Notices shall be displayed prominently reminding patrons attending
the premises to leave the premises quietly.
 
8.
The use of the outside seating and consumption of alcohol in the
external area of the premises shall cease at 21:00
hours.
 
9.
The premises shall operate a Challenge 25 policy. Such policy shall
be written down and kept at the premises. The policy shall be
produced on demand to an authorised person (as defined by Section
13 of the Licensing Act 2003) or the police or an authorised
Trading Standards Officer of the Council.
 
10.
Prominent, clear and legible signage (in not less than 32
font bold) shall also be displayed at
all entrances to the premises as well as at, at least, one location
behind any bar advertising the Challenge 25 scheme is in operation
at the premises.
 
11.
A written register of refusals shall be kept; including a
description of the persons who have been unable to provide required
identification to prove their age. Such records shall be kept for a
period of 12 months and the register shall be signed daily by the
Designated Premises Supervisor, and
produced on demand of an authorised person (as defined by Section
13 of the Licensing Act 2003) or the police or an authorised
Trading Standards Officer of the Council.
 
Basis of
Decision
In
reaching its decision, the LSC noted and gave due regard to there
being no written representations from Responsible Authorities. The
premises are also not within a Cumulative Impact Zone.
 
The
applicant at the start of the hearing formally withdrew that part
of the application in respect of sales of alcohol for consumption
off the premises. The submissions for the applicant provided an
assurance that there will be no consumption of alcohol on the
sports fields. In any event the consumption of alcohol is limited
to the premises as indicated on the plan submitted with the
application for the premises license. Any licensable activities on
the sports fields will be subject to Temporary Event Notices
(“TENs”) to which the Police and Environmental Health,
as relevant persons, could object, or other lawful authorisation
 
In
reaching its decision the LSC noted the use of the TENs by the
applicant between 18th May 2024 – 6th
July 2024 and the related representations arising in respect of
noise and nuisance.   
 
The
LSC gave due regard and weight to the written representations from
residents and ward councillors and the submissions received during
the hearing. The LSC noted in particular
the concerns and evidence relating to noise, nuisance and
anti-social behaviour in the vicinity of the premises, including
after 11pm, and concerns for congestion and related issues
attributable to traffic and limited parking in the area. The
applicant confirmed there will be 120 parking spaces available free
of charge on the site except when there are fund raising or other
events and those attending will be encouraged to use public
transport.
 
The
traffic and parking issues on the public highway are not within the
control of the applicant and it would not be proportionate or
reasonable nor permissible for the LSC to take those matters into
consideration as licensing objectives, being matters subject to
other regulatory provisions. 
 
The
LSC considered the use of the external area of the premises, and
noise and disturbance to nearby noise sensitive premises, including
at night. The LSC determined that the use of the external seating
and consumption of alcohol in the external area should cease at 9pm
daily to promote the prevention of public nuisance licensing
objective.   
 
Any
party aggrieved by this decision may appeal to the
magistrates’ court within 21 days.
