1.
Noted the circumstances in which the
contracts listed in Table 1 and Table 2 on
page 2 of the report were awarded without compliance with
the Council’s Contract Standing Orders from 1st
October 2023 for a period of 2
years.

Agreedwith effect from the date
the decision is signed until
30th September 2025, to the award of the
contracts on page 2 of this report without competition pursuant to
CSO 12.1(a) and CSO 23.1
respectively on the basis that these services can only be supplied by a
particular economic operator. Each individual
contract award has been outlined in Table 1 and Table 2 below
together with the relevant Contract Standing Order and
justification.

The awards will enable Royal Borough of Greenwich
to re-procure
new contracts enabling a transformational review of all in scope public
health current provision and the co-produced reshaping of
the contracts on that review.

In compliance with the
Public Contracts Regulations 2015, the contracts listed in Table 1
are awarded without prior publication under Regulation 32(b)(ii)
competition is absent for technical reasons. The justification for
this is because extensive market engagement and testing has been
undertaken as part of the re-procurement process which has tested
the market and the interest in these contracts. Six market
engagement events were undertaken plus a PIN and Contracts Finder
Future Opportunity Notice about the upcoming opportunities. No
alternative providers were identified as part of this process in
relation to the current contracts as they are now. The contracts
have been identified as needing a complete service redesign to
incorporate enough flexibility to deliver outcome-based services in
order to be attractive to the wider market. This will be
addressed in the re-procurement.
