The Section 38 Agreement dated 22 June 2023
was entered into by Guildford Borough Council, Surrey County
Council and relevant landowners and developers to deal with the
construction by Guildford Borough Council and adoption by Surrey
County Council of Ash Road Bridge (now called Chester
Bridge).
This Deed of Variation will also be entered into by Guildford
Borough Council, Surrey County Council and relevant landowners and
developers. It is entered into primarily to substitute various
plans to reflect minor adjustments to the final approved design of
Chester Bridge and to exclude the areas under the railway bridge
from the adopted highway (as per the side letter with Network Rail
and Surrey County Council which will be completed on the same
day.)
Pursuant to this Deed of Variation Guildford Borough Council also
agrees to pay Surrey County Council additional commuted sums of
£5,705.91 in order for Surrey County Council to maintain the
gate and fencing which Guildford Borough Council will install south
of the railway line to restrict access under the railway bridge in
this area (such gate and fencing being installed pursuant to the
side letter with Network Rail and Surrey County Council).
