The Overbridge Agreement dated 22 June 2023
was entered into by Network Rail Infrastructure Limited, Surrey
County Council and Guildford Borough Council, to enable Ash Road
Bridge (now called Chester Bridge) to be designed, constructed and
maintained over the railway line.

Clause 3.6 of that agreement envisaged that a Traffic Regulation
Order (β€˜TRO’) would be sought to restrict the use of
the area under the railway bridge by pedestrians at all times and
erect fencing and gates for the purpose of supporting that TRO.
Having taken further advice the parties no longer wish to proceed
with a TRO and the side letter, which is to be executed as a deed
by the same parties who entered into the Overbridge Agreement,
provides an alternative approach to achieve the same aim. Pursuant
to the side letter GBC shall install approved fencing and gates to
restrict access under the railway bridge. Ownership of the area
under the railway bridge to the north of the railway line shall be
retained by Guildford Borough Council who shall grant an easement
to Surrey County Council to access that area for the purpose of
maintaining the bridge. Ownership of the area under the railway
bridge to the south of the railway line shall be transferred by the
landowners to Surrey County Council who shall maintain the fencing
and gates in that location.

This side letter will be completed on the same day as the Deed of
Variation to the Section 38 Agreement dated 22 June 2023.
