To approve the grant of the telecoms code agreement for the
telecommunications mast on Land at the Spectrum Leisure Centre,
Parkway, Guildford in line with the following terms and
conditions:

The agreement will be granted to Vodafone Limited pursuant to
Schedule 3A of the Communications Act 2003, otherwise known as the
Electronic Communications Code ('the Code').

For the grant of a new code agreement the fee will be £866.44
per annum, which is the consideration for: the land on which the
mast site is erected; the consideration for the use of the existing
BT Openreach cabling/duct to supply the mast site; and compensation
for the Council’s maintenance of the mast site and the
private access track from Parkway to the gates of the athletics
track, which in accordance with the Council’s General
Disposal Consent powers, provides the ‘best consideration
reasonably obtainable’ where the proposed term exceeds seven
(7) years.

Consideration and compensation will be payable to Greenwich Leisure
Limited (GLL) for the areas that are used by Vodafone Limited as a
set-down area and access across the athletics track within the area
demised to GLL.

The Council will jointly enter into the agreement with GLL and
Vodafone Limited.

The Code agreement will provide for future compensation.

The agreed period of the term of the Code agreement is for 10 years
(although an Operator under a code agreement is entitled to renewal
rights under the Code).

The fee will be payable annually, and a proportion of the payment
will be made on the date of the agreement.

Vodafone Limited will pay our legal and surveyor’s
fees.
