The Council has received a request to grant an
easement over land at St Catherines Hill, Old Portsmouth Road,
Peasmarsh, Guildford, Surrey, in line with the following terms and
conditions:
The easement will be granted to Network Rail Infrastructure Limited
(NRIL), the current owners of adjoining operational land forming
part of the railway at Guildford Sands cutting.
The Grantees have agreed to pay £6,250 for the easement, plus
our costs, which in accordance with the Council’s General
Disposal Consent powers, provides the ‘best consideration
reasonably obtainable’ where the proposed term exceeds seven
(7) years.
The Grantees will be required to obtain our approval for a
pedestrian right of way along an access track from the adjoining
Ferry Lane, Portsmouth Road to the NRIL fenced area of land at the
crest of St Catherines Hill adjoining the embankment of the
Guildford Sands railway cutting. Access to the fenced area will be
from a pedestrian gate within the fencing. NRIL will be responsible
for keeping the fence and gate secure, repaired, and
maintained.
The easement will regularise NRIL’s use of land at St
Catherines Hill for access, the erection of fencing to prevent
access by members of the public for safety reasons, and the
installation of soil nails to stabilise the face of the
cutting.
Reasons for the decision
To formalise the use of the Council’s
property by NRIL, and to receive a premium for the grant of the
easement.
Alternative options considered
The decision meets the statutory / policy
requirements for the Council and there were no alternative options
available.
