The tenant of the property is in the process
of purchasing the property in accordance with the right to buy
legislation and at the purchase price set out in the offer notice
dated 25 March 2025. They have a gate in their rear garden that
opens out on to Council owned land so to be able to continue using
their gate they require a licence for access over the
Council’s adjoining land.
Reasons for the decision
The Council has a statutory obligation to sell
the property under the right to buy legislation, and the
tenant’s currently enjoy the access over the adjoining land
as part of their tenancy.
