Purpose

1.Approve the award of the contract for the construction of
the Internal Estate Road Phase 2 to Winvic Construction
Ltd.
 
2. To delegate to the Strategic Director of Economy,
Planning and Place, in consultation with the Lead Councillor for
Regeneration and Lead Councillor for Finance, authority to enter
into such other contracts and legal agreements connected with the
Internal Estate Road Phase 2 project as may be necessary in
compliance with Procurement Procedure Rules, the Council’s
Constitution and within the approved budget.

Decision:
Waive the Council’s
Contract Procudure Rules and, in doing so, approve the direct award
of the contract for the construction of the Internal Estate Road
Phase 2 to Winvic Construction Ltd.
 
Reason(s):

1.                    
A tender exercise was undertaken and Winvic were the
successful bidder. There were delays to the programme as a result
of obtaining necessary consents, programming and further technical
design work which were beyond the control of the Council or Winvic.
As a result it was not possible to enter the contract as tendered
with Winvic and the procurement has been abandoned.

2.                    
It is now proposed that the Council directly awards
a contract for these works to Winvic as all outstanding matters
have been resolved.  Procurement and
legal advice is that this is not a covered procurement given the
value but it must still comply with our Contract Procedure Rules
which would usually require competition.

3.                    
The recommendation in this report is therefore that
Executive waive the Contract Procedure Rules to directly award the
contract to Winvic to support the broader Weyside Urban Village
programme by facilitating the delivery of essential highways
infrastructure, critical to enabling access across the entire site.
There is a limited window of opportunity to carry out these works
in Q4 2025/26, between the completion of the construction elements
at the new Sewage Treatment Works and the operational commencement
of the new GBC depot.
 
Other options considered and
rejected by the Executive:
Do nothing.
