Decision:
1.        To approve the
2024-25 Annual Report (as set in Appendix 1 to the report) to allow
it to be published, as statutorily required.
 
2.        To formally
advertise amendments to the Guildford Off-street Parking Places
Order 2008 (as amended) to include the following:
 
(a) the
introduction of parking controls at Gardner Road Garages, Guildford
to prevent parking within the garage area other than within the
garages themselves; and
(b) the
revocation of the order at Onslow Park and Ride car park
 
and
if no representations are received, for the amendments to be made.
If representations are received, in line with the Council’s
Constitution, for these to be considered by the Joint Assistant
Director of Commercial Services, in consultation with the Lead
Councillor for Economy and Place, and a decision made to either
make, revise or not progress the proposed amendments.
 
Reasons:
1.           
Local authority parking enforcement authorities must
publish an annual report of their parking operations, revenue and
enforcement, in order to comply with the requirements of the
Traffic Management Act 2004 and the accompanying statutory
guidance, Appendix 1 provides this for the FY2024-25.
2.           
A concern has been raised about inconsiderate
parking in the garage area at Gardner Road. Although this does not
presently cause access issues for garage users, it is considered
appropriate to introduce a traffic regulation order to resolve the
present issue and prevent it from developing further.
3.           
The introduction of a TRO, which will not include
any marked parking bays, will effectively prevent vehicles being
parked anywhere within the communal areas of the garage block.
Although, strictly speaking unnecessary, this could be further
supplemented by the introduction of double yellow lines to
highlight the fact that parking is prevented. This will reduce the
risk of inconsiderate parking blocking garages and access. However,
it should be noted that the formalisation of parking will
invariably reduce garage users’ flexibility, in so far that
they would no longer be able to park their vehicles elsewhere in
the garage area, other than within their garages. However, this
arrangement would be similar to the arrangements that are already
in place at Bedford Sheds, Falcon Road and Stoke Fields garage
areas.
4.           
As the Onslow Park and Ride car park site has
reverted back to the landowner, the University of Surrey (UoS), it
is considered appropriate to revoke the TRO covering this car park.
TROs can only apply in locations where the enforcement authority
(GBC) has an ‘interest’. As the site is no longer
leased from the UoS by GBC, it no longer has an
‘interest’ in the land.

 
Other options considered and
rejected by the Executive:
The Executive could choose not
to advertise the proposed amendments to the TRO, but if it were not
to do so, it would not resolve the issues raised. Therefore, it is
recommended that these amendments are made.
