To grant an easement for vehicular access over
the roadway fronting 8 Penny Drive to provide access to and egress
from the property, and to provide pedestrian access only over part
of the garage forecourt located to the side of 8 Penny Drive, to
provide access to the property from the rear footpath and to the
side gate.
The owners of the property submitted a claim to the Land Registry
in 2023 for a prescriptive right of access over the roadway (Penny
Drive) and the garage forecourt to the side of the property.
The Council accepted that they had acquired the rights by long
user, but only as set out above. The Council objected to the claim
that the owner and their predecessors had used the garage forecourt
for vehicular access to the property which has been accepted.
The easement is being put in place to regularise the situation. In
these circumstances a premium for the easement will be £1. A
higher premium cannot be requested.
