RESOLVED:
 
The decision of 10th
December 2024
 
The Licensing Sub-Committee, in considering
this decision from the information presented to them within the
report and having regard to the promotion of the licensing
objectives:
 
· 
The prevention of crime and disorder
· 
Public safety
· 
Prevention of public nuisance
· 
The protection of children from harm
 
The application for a premises licence has
been approved in accordance with the Council’s Statement of
Licensing and the proposed conditions set out in paragraph 8.1 of
the report with the following amendments:
 
· 
The hours for licensable activities at the premises, shall be:
 
Sale
of Alcohol (On the premises)
 
Monday to Sunday  11:00 - 22:30
 
 
Sale of Alcohol (Off
the premises)
 
Monday to Sunday  11:00 - 22:30
 
The Opening hours of
the premises
 
Monday to Saturday  07:00 - 23:00
Sunday 
07:00 - 22:30
 
And the following condition shall be added to
the premises licence:
 
· 
There shall be no more than 2 smokers outside of the premises at
any one time.
 
Reasons for the
decision
 
The application for a premises licence has
been approved, as members of the Licensing Sub-committee were
satisfied that the licensing objectives would not be
undermined. 
 
The Sub-committee took into consideration that
the Responsible Authorities (Environmental Enforcement, the
Metropolitan Police Service, and the Licensing Authority) all
agreed conditions with the Applicant before the hearing and
withdrew their representations
 
The Sub-committee took into consideration
representations made by 5 Other Persons (local residents) who
objected to application on the grounds of the four licensing
objectives. The Sub-committee noted that subsequently 1 local
resident withdrew their representation after communicating with the
Applicant.
 
The Sub-committee took into consideration that
4 local residents maintained their objections to the application on
the grounds that it is a quiet residential area that already
suffers from anti-social behaviour opposite the premises. The
Sub-committee took into account that the local residents felt that
the premises will add to the negative impact on the area late at
night, and will result in local residents feeling less secure. The
Sub-committee took into account that local residents felt that this
premises would cause a disturbance late at night to a large number
of flats above the premises.
 
The Sub-committee took into consideration that
local residents made representations that the premises will affect
families with children who will be affected late at night by noise
from customers talking loudly and smoke coming from the premises.
The Sub-committee took into account representations from local
residents that off-sales of alcohol from the premises would result
in more drinking in the park, antisocial behaviour and crime and
disorder in the area. The Sub-committee noted that local residents
did not feel this was a suitable location for a premises with an
alcohol licence.
 
The Sub-committee took into consideration
representations the Applicant made that they had amended the
application for the sale of alcohol to be from 11:00 to 23:00 hours
each day. The Applicant made representations that it will be a
family run café that will benefit the local community. The
Applicant made representations that they have over 30 years of
experience operating premises and they want to operate the premises
responsibly, and not cause a disturbance or nuisance to local
residents. The Sub-committee noted that the Applicant will serve
small meze plates with a selection of beers, wines, spirits and
cocktails.
 
The Sub-committee took into consideration that
the premises is in close proximity to local residents who live in a
large block of flats above and around the premises which is
situated opposite a park and a canal which is a quiet area and
local residents have made representations that the premises will
affect their ability to have peaceful enjoyment of the area and
that it will
also affect their privacy and sustainability
of the area. The Sub-committee noted that there is a pub opposite
the premises that local residents felt was in keeping with the
area
 
The Sub-committee after considering the
representations felt that the business model would not have a
negative impact on the area. The Sub-committee took into
consideration that the Applicant agreed conditions with the
Responsible Authorities and they responded to concerns raised by
the local residents.
 
The Sub-committee felt that the premises would
not add to the cumulative impact of the area, and that the
operation of the premises will not add to anti-social behaviour and
public nuisance in the area.
 
The Sub-committee took into consideration that
the premises are small and will be operating within core hours in
accordance with the Councils Licensing Policy LP3. The
Sub-committee felt that if the hours were later the premises would
have been more of a concern. The Sub-committee felt reassured by
the conditions and that the reduced hours of the off sales that the
Applicant agreed to. The Sub-committee noted that the Applicant is
an experienced operator who demonstrated that they would operate
the premises responsibly. 
 
Having taken all of the above factors into
consideration the Sub-committee was satisfied that by granting this
premises licence that the licensing objectives would not be
undermined.
 
Public Informatives
 
1. 
The Premises Licence Holder is encouraged to work with local
residents and the Responsible Authorities to prevent any public
nuisance or negative impact in the area.
 
2. 
The Premises Licence holder is encouraged to use sustainable
cutlery, plates, cups, food containers, and recyclable disposable
materials and to avoid using single-use plastic disposable
items.
