The Licensing Sub-Committee in considering
this decision from the information presented to it within the
report and at the hearing has determined that having regard to the
promotion of all the licensing objectives:
? The prevention of crime and
disorder;
? Public safety;
? Prevention of public nuisance;
and
? The protection of children from
harm,
the application to vary a premises licence,
has been approved in accordance with the Council’s Statement
of Licensing Policy, and conditions as set out in paragraph 8.1 of
the report:
? Remove conditions 66, 76 and 77 from the
premises licence.
Amend condition 74 as follows:
“No patrons are permitted in the
external area after 2130 except for
a maximum of 4 smokers at any one
time”.
Reasons for the
decision
The application to vary the premises licence
has been approved as the Licensing Sub-Committee was satisfied that
the licensing objectives would not be undermined.
The Sub-committee took into consideration that
the Environmental Protection Service was satisfied after seeing the
Premises Licence Holder’s Noise Management Plan, and withdrew
their objection. The Sub-Committee noted that there were no other
Responsible Authorities objecting to the application.
The Sub-Committee took into consideration the
written representations made by one local resident objecting to the
application on the grounds of public nuisance and how it would
impact on the area.
The Sub-Committee noted that the premises had
regular events and the outside space could hold up to 1000 patrons
however the premises did not go beyond 800 patrons at one time
during the events that were held.
The Sub-Committee took into consideration that
the Premises Licence Holder tried to meet with the local residents
to address their concerns by holding two drop-in sessions on 24
November 2024. However, no local residents attended.
The Premises Licence Holder made
representations that the external events will be operated by an
experienced company with a strict policy and they operate
sustainably.
The Sub-Committee noted the Premises Licence
Holder will be looking to operate these events for four months in
the Summer. It was noted that historically the premises had not
held more than three events a week or 45 events a year. The
Sub-Committee noted that the premises licence holder would have
spread out the events in the summer months to prevent public
nuisance.
The Sub-Committee felt that the Premises
Licence Holder made comprehensive representations to mitigate the
impact of public nuisance on the area, and they have policies and
procedures in place to ensure the premises operate responsibly.
The Sub-Committee took into consideration that
the Premises Licence Holder has a good track record in respect of
the temporary events and the events that they hold at the premises.
Also they demonstrated they have been proactive in environmental
impact and single use plastics to reduce waste.
The Sub-Committee heard that the Premises
Licence Holder will consult with their neighbours regarding any
issues with the premises. The Sub-Committee felt that the variation
would not have an adverse effect on the area.
Having taken all of the above factors into
consideration the Sub-Committee was satisfied that by granting this
application would continue to promote the licensing objectives.

Informative
The Premises Licence Holder is encouraged to
work with local residents and the Responsible Authorities to
prevent any public nuisance or negative impact in the area.
