Reasons for the
decision
 
The application for a premises licence has
been approved as members of the Licensing Sub-Committee were
satisfied that the licensing objectives would not be
undermined. 
 
The Sub-Committee took into consideration that
the Police had withdrawn their representations and agreed
conditions with the Applicant in advance of the hearing. The
Sub-Committee took into account representations from one local
resident on the four licensing objectives.
 
The Sub-Committee took into account that the
Licensing Authority made representations that the application would
add to the cumulative impact in the area, and identified the risk
factors.
 
The Sub-Committee took into
consideration representations made by the Ward Councillor on risks
to the area. The Sub-Committee took into consideration that the
premises had operated a number of temporary events without
incident.
 
The Sub-Committee noted that the London Legacy
Authority will make any Planning decisions regarding the premises
and its operation.The Sub-Committee heard
representations from the Applicant that the SIA door security had
been enhanced for dispersal and the capacity of the premises. The
Sub-Committee took into consideration that the Applicant was an
experienced operator in Hackney for over 12 years, and the
Applicant was familiar with the nature of the area.
 
The Sub-Committee took into
consideration that the Police had no concerns.
 
Having taken all of the above factors
into consideration the Sub-Committee was
satisfied that by granting the premises
licence the licensing objectives would not be undermined.

Committee heard from the Principal
Licensing Officer (acting), the legal
representative for the Applicant, the
Applicant and the Designated Premises
Supervisor (DPS) and Responsible
Authorities (the Licensing Authority). The
application before the Sub-Committee
was a premises licence to allow
authorisation for plays, films,
indoor sporting events, live music, recorded
music, performance of dance, anything
of similar description, late night
refreshments and to authorise the
supply of alcohol for consumption on the
premises from Monday to Sunday. The
hours had been amended, to those
mentioned in Paragraph 2.2 of the
application report, as agreed between the
applicant and the Police Authority. The Police
had withdrawn their submission. The Licensing Authority had made
representation received on the grounds of the prevention of public
nuisance. A supplementary paper was submitted by the legal
representative for the Applicant outlining a series of redacted
statements in support of the application. The meeting participants
noted that the Other Persons, a local Hackney Ward Councillor, who
had made submission in objection to the application, had given
their apologies for the meeting.
