The Licensing Sub-Committee, in considering
this decision from the
information presented to them within the
report and at the hearing and having
regard to the promotion of the licensing
objectives:
 
? The prevention of crime and
disorder
? Public safety
? Prevention of public nuisance
? The protection of children from
harm
 
The application for a premises licence has
been approved in accordance with
the Council’s Statement of Licensing and
the proposed conditions set out in
paragraph 8.1 of the report.
 
? The hours of licensable activity
are as set out in the report
? Condition 14 shall be amended and
read as follows:
 “Use of the outdoor area shall cease no later
than 21:00 on any day “
And the following conditions to be added to
the premises licence:
 
? The Premises Licence Holder to
submit a Delivery Management Plan
to the Licensing Authority.
 
? The Premises Licence Holder shall
maintain a dedicated contact
telephone number and email address
that must be available at all
times. These contact details shall be
included on any website of the
premises and on display at the
premises.
 
Reasons for the
decision
 
The application for a premises licence has
been approved as members of the
Licensing Sub-Committee were satisfied that
the licensing objectives would
not be undermined.
 
The Sub-Committee took into consideration that

three local residents that attended
the hearing. The Sub-Committee noted the
Licensing Authority, the Environmental Enforcement Service and the
Police withdrew their representations and agreed conditions with
the Applicant in advance of the hearing.
 
The Sub-Committee noted that the premises
is a restaurant that has a substantial
table meal condition to serve alcohol with food by waiter waitress
service as set out in condition 13. It was noted that there are 60
flats above the premises and there is a potential that they could
be affected by noise. The local residents made representations
about vans driving onto the pavement and deliveries.
 
The Sub-committee felt that with reduced hours
in the outside area to 21:00 would prevent public nuisance, and a
Delivery Management Plan to mitigate
disruption to local residents.
 
The Sub-Committee took into account that the
Applicant is an experienced operator and has over 12 years experience running
another café in Stoke Newington. The Applicant made
representations that they had not previously dealt with litter and
now have waste collections two times a week. The Applicant
confirmed that they are happy with all the conditions proposed. The
Sub-Committee noted that the premises have a tables and chairs
licence, the Applicant will train their staff and ensure the
premises are monitored.
 
The Sub-Committee took into consideration that
the Applicant made representations that they are operating a small
family café, and the premises
will not be a bar service and there will be no
vertical drinking on the premises.
The capacity of the premises is 58 in total;
45 persons inside and 18 persons
outside.
 
The Sub-Committee noted the local residents
made representations that the premises is in a quiet residential area that may result in
disturbance late at night. The local residents felt that even if
the premises operated responsibly they would not be able to control
every aspect and local residents would suffer as a result
experiencing noise, smoking, litter and antisocial behaviour. The
local residents had concerns about crime and disorder, public
safety
drunken behaviour and nighttime noise.
 
The Sub-Committee noted the local residents
maintained their objections after
hearing from the Applicant because of their
concerns about the negative impact it will have on the area and the
local residents that live above the premises.
 
The Sub-Committee felt the Applicant mitigated
the noise impact by closing the external area no later than 21:00
and this will allow respite for the local residents that live in
close proximity.
 
The Sub-Committee had concerns about waste
management and deliveries and the Applicant has taken these
concerns seriously and improved their waste disposal. The
Sub-Committee took into consideration that the premises would not
carry on alcohol sales until after school hours, so would have
limited impact on the school nearby.
 
Having taken all of the above factors into
consideration the Sub-Committee was satisfied that by granting the
premises licence the licensing objectives would not be
undermined.

Informative
1. The Premises Licence Holder is
encouraged to continue working with
local residents to prevent any public
nuisance or negative impact in the
area.
2. If local residents have concerns
in the future about the premises they
can report these to the Licensing
Authority.
3. The Premises Licence Holder is strongly
encouraged to use
sustainable cutlery, plates, cups, food
containers, and recyclable
disposable materials to avoid using single-use
plastic disposable
items.
