The Licensing Sub-Committee, in considering
this decision from the information presented to them within the
report and at the hearing and having regard to the promotion of the
licensing objectives:

been approved in accordance with the Council’s Statement of
Licensing and the proposed conditions set out in paragraph 8.1 of

Reasons for the
decision
 
The application for a premises licence has
been approved as members of the Licensing Sub-Committee were
satisfied that the licensing objectives would not be
undermined. 
 
The Sub-Committee took into consideration that
there were representations from the Environmental Protection
Service on the grounds of public nuisance. The Sub-Committee noted
that the Police and Weights and Measures (Trading Standards
Service) had withdrawn their representations following the
Applicant’s agreement not to use a vending machine to
dispense alcohol and to remove off sales from the application. The
Sub-Committee noted there were no representations from other
Responsible Authorities
 
The Sub-Committee took into consideration that
there were representations from 3 Other Persons (local
residents).
 
The Sub-Committee heard the Applicant’s
representations that the premises  is not a nightclub it is a second hand
record shop where customers can purchase alcohol while listening to
music. The Applicant contended there are no hot beverages, only
soft drinks and bottles of water.
 
The Sub-Committee heard the premises are one
of the biggest second hand record shops in the area. The Applicant
made representations that they wanted to alleviate any concerns as
far as possible and they wanted to support the area.
 
The Sub-Committee heard the Applicant’s
representations that the premises 
is a deterrent, and they wanted to prevent
antisocial behaviour. The Applicant made representations that the
premises had 10 temporary events. They had authorised alcohol sales
and there were no known problems. The Applicant made
representations that on most Saturdays DJs were given a
two hour slot. The temporary events are
run at different times to allow an open space. The premises have
only been open on weekends and Fridays. It was noted that Sunday is
a quiet day.
 
The Sub-Committee took into account the
representations from the local residents, and their concerns about
crime and anti-social behaviour as it is a warehouse with no
windows. The Sub-Committee took into consideration that the local
residents had lived in the area for over 20 years. The
Sub-Committee noted the local residents are part of a neighbourhood
watch and they work with the Police to protect the area. The local
residents contended that it is important for residents, and the
community to be heard, and for public safety concerns to be
addressed. The Sub-Committee noted that the premises was previously used as a place of worship. The
Sub-Committee noted that the capacity of the premises is 50
customers.
 
The Sub-Committee felt that the Applicant
mitigated the impact and they wanted to work with the community.
The Sub-Committee noted the Applicant
resolved issues with the Responsible
Authorities, and there were no known issues arising from temporary
events held at the premises.
 
Having taken all of the above factors into
consideration the Sub-Committee was satisfied that by granting the
premises licence the licensing objectives would not be
undermined.
