RESOLVED:
The decision
The Licensing Sub-Committee, in considering
this decision from the information presented to them within the
report and at the hearing and having regard to the promotion of the
licensing objectives:

The prevention of crime and disorder
·
Public safety
·
Prevention of public nuisance
·
The protection of children from harm
the application for a premises licence has
been approved in accordance with the Council’s Statement of
Licensing and the proposed conditions set out in paragraph 8.1 of
the report, with the following amendments:
Amend condition 29 as follows:
·
“The external area will not be used after 22:30 hours except
for patrons permitted to temporarily leave and re-enter the
premises, e.g. to smoke, and shall be limited to 10 persons at any
one time”.

The Licensing Authority shall agree to the capacity following the
Fire Risk Assessment being submitted.
And the following conditions to be added to
the premises licence:

Alcohol to be served ancillary to food before 11 am.
·
No single bottles of spirits to be sold for consumption off the
premises after 22:00
Reasons for the
decision
The application for a premises licence has
been approved, as members of the Licensing Sub-committee were
satisfied that the licensing objectives would not be
undermined.
The Sub-committee took into consideration that
no Responsible Authorities objected to the application. There was
one representation from a local resident (Other Persons). The
Sub-committee took into account that the local resident felt that
the Applicant’s representations did not address any of
their
concerns.
The Sub-committee took into consideration that
the premises, that is a large building divided into two, is located
in the Shoreditch area, which attracts high levels of public
nuisance and anti-social behaviour which has an impact on local
residents.
The Sub-committee noted that the bar has an
existing premises licence and that the bar would continue to
operate unchanged.
The Sub-committee took into consideration that
the hours were in accordance with Core Hours (Policy LP3), there
were robust conditions, and there is a strong lease in place which
the Applicant must comply with. The Sub-committee took into account
that the Applicant agreed a condition to reduce the consumption of
single bottles of spirits after 22:00, in the external area no more
than 10 smokers, and alcohol will be served ancillary to food
before 11 am. The Sub-committee noted that the capacity of the
premises has increased slightly.
The Sub-committee felt the supporting
documents produced by the Applicant were thorough and well thought
out, and they felt that the reduction of the consumption of spirits
after 22:00 would help reduce any impact on the area.
The Sub-committee took into consideration that
the Applicant was willing to work with the Responsible Authorities,
and the Sub-committee were satisfied with the operational controls,
and the information provided was helpful to see how the premises
will operate in the future.
The Sub-committee took into consideration the
local resident’s representations and concerns about the
premises. However, what was agreed by the Applicant during the
hearing did go someway to reducing the
concerns of the local resident.
The Sub-committee felt that the Applicant
demonstrated that they would be responsible operators, and that the
premises would not cause a public nuisance.
Having taken all of the above factors into
consideration the Sub-committee was satisfied that by granting this
premises licence, the licensing objectives would not be
undermined.
Public Informatives
1.
The Premises Licence holder shall surrender the existing licence on
issue of the new premises licence.
2.
The Premises Licence holder is advised as part of the rigorous
monitoring and checking that all staff are to be well trained, and
to undertake the required training including WAVE training,
training for
vulnerable persons and other
training offered by the Council’s Hackney Nights portal.
3.
The Premises Licence holder is strongly encouraged to use
sustainable cutlery, plates, cups, food containers, and recyclable
materials to avoid using single-use plastic items to prevent
litter, and to protect the environment.
