RESOLVED:
The decision
The Licensing Sub-Committee, in
considering this decision from the information presented to them
within the report and at the hearing and having regard to the
promotion of the licensing objectives:
·
The prevention of crime and disorder
·
Public safety
·
Prevention of public nuisance
·
The protection of children from harm
The application for a premises
licence has been approved in accordance with the Council’s
Statement of Licensing and the proposed conditions set out in
paragraph 8.1 of the report:

activities have been granted as applied for
on the
report.
And the following conditions to
be added to the premises licence:

The Premises Licence Holder shall submit a revised
plan of the premises to the Licensing Authority to remove the
hatched area (the coffee shop).
·
The Premises Licence Holder shall submit a revised
Dispersal Policy to the Licensing Authority.
·
The maximum number of persons (excluding staff)
allowed at the premises shall not exceed 100 patrons except for
pre-booked private functions events where the capacity may increase
to 220 (excluding staff) subject to an ongoing fire risk
assessment.
·
There shall be no more than 8 smokers permitted
outside at any one time.
·
No fumes, steam or odours shall be emitted from the
licensed premises so as to cause a nuisance to any persons living
or carrying on business in the immediate area where the premises
are situated.
·
The Premises Licence holder shall maintain a
dedicated contact telephone number and email address that must be
available at all times to any person wishing to report concerns or
make a complaint. These contact details shall be included on any
website of the premises and on display at the premises
Reasons for the
decision
The application for a premises
licence has been approved, as members of the Licensing
Sub-Committee were satisfied that the licensing objectives would
not be undermined.
The Sub-Committee took into
consideration that one Other Person (a local resident) made
representations on the grounds of the prevention of public
nuisance.
The Sub-Committee took into
consideration that there were no representations from the other
Responsible Authorities.
The Sub-Committee considered
that the premises is a seafood
restaurant with class E planning use in a railway arch close to
London Fields station. The Applicant proposed the sale of alcohol
and late night refreshment within licensing policy LP3. The
Sub-Committee noted that there is no regulated entertainment
proposed.
The Sub-Committee took into
account the representations from the local resident that although
they note the premises will be operating within core hours they
have concerns and object to the application particularly in respect
of odour and noise nuisance.
The Sub-Committee heard the
local resident’s representations that they were affected by
odours that will prevent them from using their balcony. It was
noted that the smokehouse stops at midday. The local resident made
representations about the kitchen extraction fan, the fish, grease
and plant noise, and they are unclear as to how this can be
controlled by the Applicant.
The Sub-Committee took into
consideration local residents submitted additional information on
noise and odour concerns.
The Sub-Committee heard
representations from the Applicant’s legal representative
that there was no connection between the smokehouse and the
premises. The Applicant’s representative made representations
that they cannot put the extractor fan in front of the premises as
it will be closer to residents that may be affected.
The Sub-Committee took into
account the Applicant’s representative’s
representations that the premises is not
a bar. It is a modest proposal and all objections were taken on
board by the Applicant and the conditions will promote the
licensing objectives. The Applicant felt that the local resident
was reasonable in their objections and comments.
The Sub-Committee took into
consideration that the Applicant previously had a discussion with
the Environmental Protection Team regarding odour and
noise management for the
kitchen extraction. They also discussed the necessary works to
reduce any impact on the nearest dwellings.
The Sub-Committee took into
consideration the local resident’s representations about
noise nuisance, dispersal from the premises, smoking, deliveries
and collections from the premises. The local resident made
representations that they were concerned about the cumulative
impact of the premises late at night when patrons are dispersing.
The local resident contended that the premises will enable
off-sales and street drinking, smoking outside of the premises,
delivery vehicles and waste which will have a negative
impact.
The Sub-Committee took into
consideration that the Applicant responded to the local
residents representations on the 24th of
October 2025. The Applicant referred the local resident to the
proposed conditions set out in their letter. In addition, they will
install a modern and robust kitchen extraction system that will be
capable of addressing their concerns. The Applicant made
representations that they will monitor their customers when they
arrive and disperse from the premises. The Applicant agreed to
implement a dispersal policy to mitigate any noise nuisance or
disturbance late at night.
The Sub-Committee took into
account the premises is a food-led restaurant and they felt the
following conditions mitigated any negative impact which will help
the premises operate responsibly: condition 20 - Dispersal Policy,
condition 11 - off sales in sealed containers only, the capacity of
the premises and seated customers, a condition relating to the
extractor fan will be added to the premises licence, condition 34
deals with deliveries to the premises, there will be no more than 8
smokers outside at any one time, a revised plan required to submit
the Licensing Authority will exclude the area hatched.
Having taken all of the above
factors into consideration the Sub-Committee was satisfied
that by granting this variation of the premises licence, the
licensing objectives would continue to be promoted.
Public Informative
1.
The Premises Licence Holder is reminded of the need
to operate the premises according to any current planning
permission relating to its use class, conditions and to regularise
the hours as required.
2.
It also should be noted for the public record that
the Local Planning Authority should draw no inference or be bound
by this decision with regard to any future planning application
which may be made.
3.
The Premises Licence Holder is strongly encouraged
to use sustainable cutlery, plates, cups, food containers, and
recyclable disposable materials to avoid using single-use plastic
disposable items.
