RESOLVED:
The decision
The Licensing sub-committee in considering this decision
from the information presented to it within the report and at the
hearing today has determined that having regard to the promotion of
all the licensing objectives:
?
The prevention of crime and disorder;
?
Public safety;
?
Prevention of public nuisance;
?
The protection of children from harm;
The application for a premises licence has been approved in
accordance with the Council’s Statement of Licensing Policy
and the conditions set out in paragraph 8.1 of the report, with the
following amendment :-

removed from the licence as it does not apply to this
premises.
And the following condition:

The Premises Licence
Holder shall organise and publicise a meeting for local residents
and/ or representatives of the local residents to discuss the
operation of the premises at least every 3 months. The frequency of
meetings may be varied by agreement between the Premises Licence
Holder and local residents.
Reasons for the decision
The Sub-committee approved the amended application with the
above amendments and an additional condition for on-sales and
off-sales of alcohol at the premises to
prevent the licensing objectives being
undermined.
The Sub-committee took into consideration that the
Applicant had agreed conditions with the Metropolitan Police
Service, Environmental Protection and Environmental Enforcement in
advance of the hearing, and these Responsible Authorities
subsequently withdrew their objections to the
application.
The Sub-committee also took into consideration the 9
objections raised by Other Persons (local residents) on the grounds
of Public Safety and The Prevention of Public Nuisance and the
Prevention of Crime and Disorder because the premises are close to
a residential area.
The Sub-committee heard from the Other Persons and the
persons that spoke on behalf of other residents and a small
residential block and neighbours. The Other Persons made
representations that there was nothing in the arch for some time.
The premises will be close to residential homes. The Planning use
was not clear to local residents. Local residents of Great Eastern
Street want to be consulted and would welcome regular meetings with
the premises licence holder.
After considering all the representations made by the
parties, the Sub-committee took into consideration that the
premises is a small restaurant with a capacity 22 which provides
natural wines and foods. The Sub-committee took into account that
any alcohol will be ancillary to food, there will be no outside
eating and drinking, no music will be played at the premises other
than background music, the Applicant will ensure no music will
escape from the premises to prevent noise nuisance. The
Sub-committee noted that the Applicant’s intention was to
close the premises one day a week and not open seven days a
week.
The Sub-committee felt it was necessary for there to be at
least in the first 12 months of operating regular consultations
with local residents or representatives of the local residents of
Great Eastern Street to ensure any issues arising are addressed.
The Sub-committee encourages the Applicant to work in collaboration
with local residents and engage with them as much as possible to
prevent noise nuisance. If Local residents encounter issues in the
future they can inform the Licensing Authority of their concerns
which can be investigated.
The Sub-committee took into consideration the concerns of
local residents and felt that the Applicant needed a period of time
to demonstrate they could comply with the conditions on their
licence.
The Sub-committee took into consideration that the
Applicant had worked with the Responsible Authorities to try and
resolve issues. The Sub-committee felt that the Applicant
demonstrated their intention to operate the premises
responsibly.
Having taken all of the above factors into consideration,the Licensing Sub-committee was
satisfied that the application could be approved without the
licensing objectives being undermined.
Public Informative
The premises licence holder is encouraged to continue
working with the local residents to deal with any issues arising at
the premises and to prevent noise nuisance.
