The decision
The Licensing Sub-Committee, in considering
this decision from the information presented to them within the
report and at the hearing and having regard to the promotion of the
licensing objectives:

the application for a premises licence has
been approved to in accordance with the Council’s Statement
of Licensing and the proposed conditions set out in paragraph 8.1

Amend condition 47 as follows:
"The Premises Licence holder to hold
and publicise at least every 6 months liaison meetings with local
residents to address any concerns or complaints about the premises
".
And the following conditions:
Any off-sales of alcohol must be in sealed containers.
The garden and outside area shall be closed by 22:00 each day.
At least 1 SIA door security on Friday and Saturday from 23:00
until 30 minutes after closing to ensure customers disburse from
the premises securely.
The Premises Licence holder to submit a Dispersal Policy to the
Licensing Authority and the Police for approval and to be available
at the premises on request by an authorised officer.
All staff including Management engaged in the sale of alcohol shall
be fully trained and made aware of the legal requirements relating
to underage sales and other legal requirements relating to the sale
and supply of alcohol. Such training must take place on a 12
monthly basis and written records of the training must be
maintained on the premises for inspection by the Police or
Authorities. This training is to include Conflict Resolution
training and the Welfare And Vulnerability Engagement (WAVE)
training and Ask Angela training.
Reasons for the
decision
The application for a premises licence has
been approved, as members of the Licensing Sub-committee were
satisfied that the licensing objectives would not be
undermined.
The Sub-committee took into consideration that
the Responsible Authorities (the Environmental Protection Team, the
Environmental Enforcement Team, and the Metropolitan Police Service
("the Police") made representations on the grounds of crime and
disorder and prevention of public nuisance, however, they agreed
conditions in advance of the hearing and withdrew their
representations. The Sub-committee noted no local residents
objected to the application.
The Sub-committee took into consideration the
representations made by the Licensing Authority on the grounds of
crime and disorder, and the prevention of public nuisance in a
residential area. In addition the extension of licensable hours
beyond core hours contrary to Policy LP3 and the concerns about
dispersal from the premises taken altogether would undermine the
licensing objectives, and have an impact on the local
residents.
The Sub-committee took into account that the
Licensing Authority also maintained their objection on grounds of
policy, ongoing planning issues where
planning permission was required by the premises contrary to Policy
LP5 for change of use of the ground floor from sui generis
(workspace and auxiliary café) to sui generis (workspace and
auxiliary drinking establishment (A4)) with additional outdoor
seating spaces.
The Sub-committee felt that the premises had
operated a number of Temporary Events and there were no crime and
disorder issues arising from those events. The Sub-committee noted
that the premises is a small venue. It was noted that the outdoor
area and garden would be closed from 22:00. The Sub-committee took
into consideration that the Applicant had carried out soundproofing
works to the premises. The Sub-committee noted that the
Environmental Protection Team had set the noise limiter at the
premises.
The Sub-committee carefully considered the
evidence presented to them, and took into consideration the
measures that the Applicant had put in place. The Applicant agreed
to have SIA door security until 30 minutes after closing to ensure
dispersal is carried out safely. The Sub-committee felt reassured
that the off-sales would cease at 23:00 hours and the alcohol to be
sold in sealed containers. The Applicant also agreed to hold
liaison meetings at less twice a year to address any concerns local
residents may have.
Having taken all of the above factors into
consideration the Sub-committee was satisfied that by granting this
premises licence that the licensing objectives would not be
undermined.
