RESOLVED:
 
The Licensing Sub-Committee in considering
this decision from the information presented to it within the
report and at the hearing has determined that having regard to the
promotion of all the licensing objectives:
 
· 
The prevention of crime and disorder;
· 
Public safety;
· 
Prevention of public nuisance; and
· 
The protection of children from harm,
 
the application for a premises licence has
been approved in accordance with the Council’s Statement of
Licensing Policy and the proposed conditions set out in paragraph
8.1 of the report, with the following amendments:
 
· 
The hours for licensable activities at the premises, shall be, as
set out in the report to the Sub-Committee.
 
And the following conditions:
 
· 
The Environmental Enforcement Team conditions agreed by the
Applicant
· 
at paragraph 8.1 of the report.
 
· 
Alcohol shall be consumed by customers who are seated at the
premises.
 
· 
No vertical drinking shall be permitted inside or outside of the
premises.
 
Reasons for the
decision 
 
The application for a premises licence has
been approved because the Licensing Sub-committee was satisfied
that the licensing objectives would not be undermined.
 
The Sub-Committee took into consideration that
the Applicant agreed conditions with the Police and the
Environmental Enforcement Team which resulted in them withdrawing
their representations to the application. The Sub-Committee noted
there were no other representations from the other Responsible
Authorities.
 
The Sub-Committee took into consideration that
there was one representation made against the application from a
local resident on the grounds of the four licensing objectives.
 
The Sub-Committee noted that the local
resident made representations in particular about noise due to a
significant change in how the premises had been operating. The
Applicant made representations that they are prepared to add extra
signage to prevent any unreasonable noise.
 
The Sub-Committee took into consideration that
the premises are closed on Sundays from 4 pm to take into
consideration the residential area. The premises has been operating for over five years and provides
vegan food and they want to offer alcohol with the menu. The
Applicant confirmed that there is no vertical drinking and alcohol
is served at tables to seated customers.
 
The Sub-Committee was satisfied with the
premises and the Applicant’s response to the local
resident’s representations.
 
The Sub-Committee took into account that the
premises are only open until 5 pm and they have been complying with
the terms of their lease which requires them to close at 5 pm. The
Sub-committee felt that the operation of the premises would not
result in more noise or public nuisance in the area, and they took
into consideration the conditions above that the Applicant had
agreed to.
 
The  Sub-Committee was satisfied that the
additional conditions would address the concern raised by the local
resident.
 
Having taken all of the above factors into
consideration the Sub-Committee was satisfied that by granting this
application the licensing objectives would not be undermined.

continue working with local residents and Responsible Authorities
to prevent any public nuisance or negative impact in the area.
