Temporary Event Notice (TEN) - Counter Notice: 51a Tudor Road,
London E9
7SN
 
The Licensing Sub-committee, in considering
this decision from the information presented to it within the
report and at the hearing today, has determined that having regard
to the promotion of all the licensing objectives:
 
· 
The prevention of crime and disorder;
· 
Public safety;
· 
Prevention of public nuisance; and
· 
The protection of children from harm
 
and in particular upon consideration of the
‘objection’ given by the Metropolitan Police Service
and the Environmental Protection Team, decided that it was not
appropriate to issue a Counter Notice.
 
Reasons for the
decision
 
The Sub-committee took into consideration the
objection received from the Metropolitan Police Service (“the
Police”) and the Environmental Protection Team to the
Temporary Event Notice for the period on 06/07/2024 from 14:00
finishing on 06/07/2024 at 23:00, which
contended that this event would undermine the licensing objectives,
on the grounds of the prevention of crime and disorder and the
prevention of public nuisance.
 
The Sub-committee took into consideration
representations from both the Police and the Environmental
Protection Team who objected to this Temporary Event because the
premises had received complaints from nearby residents alleging
disturbances from patrons shouting and the playing of loud music
all day until late at night at 01:00. The football match finished
at 22:00 hours and people were still shouting, being noisy and
allowed to exit via the building's private gate. The entrance to
the premises is also a security issue in addition to the noise.
 
The Sub-committee took into consideration the
written representations that the Temporary Event was a
“Hackney fan zone”, a series of events in a warehouse.
The Sub-committee took into account that the premises are located
in the middle of several large residential blocks of flats.
 
The Environmental Protection officer made
representations that they received six complaints as a result of an
event on the 16th June. The Temporary Event was initially objected
to on that occasion. However, this was withdrawn. The Environmental
Protection Team subsequently received complaints from local
residents as a result of 2 of the 3 Temporary Events that had
already taken place. The Premises User accepted and apologised for
the complaints, and said that it was not a rowdy event; a lot of
good things came out of the event. It was their first Temporary
Event. There was a misunderstanding about the use of the building
and the Premises User wrote to local residents and apologised for
the disturbance caused.
The Sub-committee felt that the Premises Users
have demonstrated that they have adjusted how they will manage and
operate the Temporary Event and are trying to keep the Temporary
Event under control to prevent noise nuisance. 
 
The Sub-committee took into consideration that
the Premises Users agreed not to have DJ’s at the Temporary
Event. The Sub-committee also took into consideration that the
Temporary Events coincide with England's fixtures during the Euro
2024 football tournament.  The
Sub-committee felt that the finishing time of the Temporary Event
was reasonable and would not cause a nuisance. 
 
The Sub-committee felt that the Premises Users
appeared to be honest and took on board the representations made
about the Temporary Event causing a public nuisance. The Premises
Users showed that they were prepared to do what was asked of them
to prevent noise nuisance and disturbance to local residents.
 
Having taken the above
representations into account the Sub-committee
Decided not to issue a Counter
Notice.

The Licensing sub-committee, in considering
this decision from the information presented to it within the
report and at the hearing, has determined that having regard to the

and in particular upon consideration of the
‘objection’ given by the Metropolitan Police Service,
is satisfied that the proposed event would undermine the licensing
objectives. Therefore, the Sub-committee has decided to serve a
counter notice.
 
Reasons for the
decision
 
The Licensing Sub-committee took into
consideration the objection received from the Metropolitan Police
Service (“the Police”) to the Temporary Event Notice
for the period from on 09/07/2024 from 09:00 finishing on
15/07/2024 at 01:00 am, which contended that this event would
undermine the licensing objectives, on the grounds of the
prevention of crime and disorder, and the prevention of public
nuisance. The Sub-committee considered the reasons for this
objection. The Sub-committee considers each case on its own
merits.
 
The Sub-committee took into consideration that
the Premises User did not attend the hearing and did not
communicate with the Police and Licensing Authority prior to the
hearing.
 
 
The Sub-committee took into account
representations from the Police that the proposed Temporary Event
from 9 - 15 July would operate for 24 hours a day for a number of
days. The Sub-committee noted the Premises User did not provide any
information about how they would manage this event to the Police or
the Licensing Authority.
 
On balance, the Sub-committee considered that
the event would contribute to noise nuisance late at night that
will add to anti-social behaviour and negative impact in the
area.
 
The Sub-committee therefore considered that
allowing this event to take place in accordance with the Temporary
Event Notice would undermine the licensing objectives. The
Sub-committee decided that it was necessary and proportionate to
issue a counter notice.
