The decision of 2nd
September 2024
 
The Licensing Sub-Committee, in considering
this decision from the information presented to them within the
report and at the hearing and having regard to the promotion of the
licensing objectives:
 
· 
The prevention of crime and disorder
· 
Public safety
· 
Prevention of public nuisance
· 
The protection of children from harm
 
The application for a premises licence has
been approved in accordance with the Council’s Statement of
Licensing and the proposed conditions set out in paragraph 8.1 of
the report.
 
Sale of Alcohol (On
the premises)
 
Monday to Saturday  10:00 - 22:00
Sunday

Monday to Saturday  10:00 - 22:30

- Remove Off-sales from the
Application. 
 
And the following conditions to be added to
the premises licence:
 
· 
No deliveries are permitted to the premises between 23:00 -
08:00.
· 
A maximum of 14 people shall be allowed on the terrace at any one
time.
· 
A maximum of 6 smokers shall be permitted outside the premises at
any one time.
 
Reasons for the
decision
 
The application for a premises licence has
been approved as members of the Licensing Sub-Committee were
satisfied that the licensing objectives would not be
undermined. 
 
The Sub-Committee took into consideration that
the Environmental Enforcement Service, the Licensing Authority had
withdrawn their representations and agreed conditions with the
Applicant and the application had been amended to remove off sales
in advance of the hearing. It was noted no other representations
were made by local residents. 
 
The Sub-Committee took into consideration the
representations made by
a local resident. The local resident contended
that this would be another business in Shoreditch. The owner does
not live in the area and is not aware of the impact on the local
residents, and their concerns about undesirable activity in the
area.
 
The Sub-Committee took into consideration
representations made by the local resident about both Derham Place and residents properties being blocked
as it is not an ideal location for smokers due to the impact on
local residents.
 
The Sub-Committee took into consideration
representations from the Applicant that the premises sell plant
based products and they operate within core hours. The
Sub-Committee noted the premises serves tea coffee, food offerings
and plant-based cocktails all day. It was noted that one of the
aims of the business was to make women comfortable. The Applicant
contended that Curtain Road alleyway is off the street outside of
the area and off the pavement.
 
The Sub-Committee took into consideration that
the Applicant was an experienced operator with other premises in
London.
 
The Sub-Committee decided to grant the
application. They took into consideration the conditions that had
been agreed with the Responsible Authorities, and the hours are
within Policies LP3 (Core Hours) and LP6 (External Areas and
Activities).
 
The Sub-Committee when making their decision
took into account the evidence from the local resident and that the
hours were granted less than initially sought. The Sub-Committee
noted that substantial food would be available at all times. The
Sub-Committee took into account that the Applicant was prepared to
work with local residents, and  the
Applicant agreed to remove the off-sales from the application. The
Sub-committee noted there were no concerns about pre-loading. The
Sub-Committee took into consideration that the alcohol served in
internal areas will be served with a meal.
 
Having taken all of the above factors into
consideration, the Sub-Committee was satisfied that by granting the
premises licence the licensing objectives would not be
undermined.
