The Licensing Sub-Committee, in considering
this decision from the information presented to them within the
report and having regard to the promotion of the licensing
objectives:

The application for a premises licence has
been approved in accordance with the Council’s Statement of
Licensing and the proposed conditions set out in paragraph 9.1 of
the report:

The Premises Licence Holder shall submit a Crowd and Noise
Management Plan for approval to the Licensing Service.

A copy of the Crowd and Noise Management Plan shall be kept on the
premises and shall be produced to a Police officer or other
authorised officer upon request.
 
· 
The smoking area to be positioned to the west of the site close to
the entrance of the premises.
 
· 
The SIA door security to remain at the premises at least 20 minutes
after closing.
 
Reasons for the
decision
 
The application for a premises licence has
been approved, as members of the Licensing Sub-committee were
satisfied that the licensing objectives would not be
undermined. 
 
The Sub-committee took into consideration
representations from the Licensing Authority on the grounds of
public nuisance. The Sub-committee noted that there were no
objections from other Responsible Authorities including the Police
and the Environmental Protection Service.
 
The Sub-committee took into consideration 13
objections to the application from Other Persons (local residents)
under the four licensing objectives. The Sub-committee took into
account that the local residents from Springfield House made
representations about the impact of noise, safety, privacy and the
negative impact on all the residents and young families late at
night. It was noted that one of the local residents had met with
the Applicant and they were satisfied with the proposal which
overcame their concerns.
 
The Sub-committee took into consideration that
the premises are located in close proximity to a residential area,
and that the premises will be operating within core hours in
accordance with the Councils Licensing Policy LP3. The
Sub-committee noted that the premises will be operating on Thursday
to Sunday only. It was noted that the proposed start time will help
to facilitate any daytime activities including bakery and community
events..
 
The Sub-committee took into account the
representations made by the Applicant’s legal representative
that the Applicant intended to transform the dilapidated taxi
repair yard into something of value for the community. The
Applicant’s legal representative made representations that
the Applicant would be focusing on seated hospitality for guests
and on arts and well-being programs for parents and children such
as a cooking club.
 
The Sub-committee took into consideration that
the Applicant intends to limit the days and hours during which the
activities are proposed: a small bakery and coffee shop during the
day with the full site opening later in the day. The Sub-committee
took into account that the Applicant did not include regulated
entertainment, and that they are working with an acoustic
consultant to prepare a noise management plan. The Sub-committee
noted that the Applicant had kept the Springfield House residents
informed about the development of the premises.
 
The Sub-committee took into consideration
there was no proposal for live music or recorded music, and that
music will be played at background level to add ambience to the
activities. It was noted that there will be no large speakers, only
small sound speakers will be used to provide ambient music. The
Sub-committee noted that the Applicant had constructed roofing in
areas closest to Springfield House to create privacy between the
site and the residential area.
 
The Sub-committee took into consideration that
the conditions 8 - 31 as set out at paragraph 9.1 of the Licensing
Report sought to mitigate any impact the ?application may have on
the area. The Sub-committee felt that the conditions addressed the
concerns raised by the local residents. The Sub-committee
considered reducing the operating hours, however, on balance they
were satisfied with the operating procedures. The Sub-committee
took into consideration that the Applicant submitted a dispersal
policy to the Licensing Authority.
 
The Sub-committee took into consideration that
the Applicant is an experienced operator who has lived in the
Dalston area for over 11 years and has
an understanding of the locality. The Sub-committee noted that the
Applicant had applied for planning permission.
 
The Sub-committee felt the Applicant
demonstrated that they were willing to work with local residents,
and the Responsible Authorities to prevent any antisocial behaviour
or public nuisance. The Sub-committee took into account that the
Applicant had engaged with local residents and tried to address any
concerns in advance of the hearing.
 
Having taken all of the above factors into
consideration the Sub-committee was satisfied that by granting this
premises licence that the licensing objectives would not be
undermined.
 
Public Informatives
 
1. 
The Premises Licence Holder is reminded of the need to operate the
premises according to any current planning permission relating to
its use class, conditions and to regularise the hours as
required.

It also should be noted for the public record that the local
planning authority should draw no inference or be bound by this
decision with regard to any future planning application which may
be made.
 
3. 
The Premises Licence Holder is encouraged to work with local
residents and the Responsible Authorities to prevent any public
nuisance or negative impact in the area.

The Premises Licence holder is encouraged to use sustainable
cutlery, plates, cups, food containers, and recyclable disposable
materials and to avoid using single-use plastic disposable
items.
