That authority is given for the making a
diversion order under Section 119 of the Highways Act 1980 to
divert part of Whiteley Footpath 722, as shown on the
Location
Map at Appendix 1. The proposed diverted route will have a width of
2 metres as shown between Points A and C on the attached
plan.
That the Order be confirmed as an unopposed Order if no objections
or representations are received, on the basis that the Council is
satisfied that the relevant legal tests are
satisfied; or, if objections or representations to the Order are
received that they be submitted to the Secretary of State with a
request that the Order be confirmed, subject to any additional
evidence that comes to light as a result of this process.
