That in accordance with the delegated approval
given by the Executive Member for Hampshire 2050 and Corporate
Services at its meeting of 31 July 2024 (under paragraph 1.1 of the
Decision Record and table 1 of the report) for the Director of
Hampshire 2050 (in consultation with the Executive Member for
Hampshire 2050, the Chief Executive, the Director of Corporate
Operations and Deputy Director Legal Services and Monitoring
Officer) to exercise the delegated authority to:
(a) agree the part surrender of the Farm Business Tenancy (FBT),
part surrender of land subject to the 999- year lease, addition of
land by way of supplemental lease
to the existing 999-year lease, and for a diversion of the footpath
(subject to statutory approvals) to cross land subject to the
999-year lease to facilitate The Manydown Company Ltd undertaking
the proposed Manydown Park Drive improvement to facilitate proposed
changes to Manydown Park Drive;
(b) subject to statutory approvals to a dedication of a new section
of bridleway crossing the land within the 999-year lease on the
basis set out in exempt Appendix to this report; and
(c) the variation and rectification of a Deed of Mutual Grant dated
18 October 2024;
and
(d) the Council and Manydown Garden Communities LLP entering all
necessary documentation to give effect to the above
decisions.
