Decision
RESOLVED
that a contract in the sum of £784,294.98 be
awarded to Chas Berger Ltd. (company number 00359611) “subject to contract and leaseholder
consultation”. The contractor will be engaged using the JCT
Intermediate Building Contract (2024) with Contractor’s
Design, and the Council’s standard Schedule of
Amendments.
Reasons for the decision
Undertake essential fire safety
works, that will address risks and hazards identified in the Fire
Risk Assessment and ensure residents can live safely in their
homes. External and communal repairs will also be undertaken as
part of this project, including replacement of stairwell
balustrade, electrical & decoration works. This work is
necessary to ensure the Council meets its obligations to maintain
the block and comply with statutory requirements. They will also
contribute to reducing future maintenance needs and improve thermal
efficiency. Chas Berger Ltd submitted the most advantageous
tender.
Alternative options considered
Do nothing: Withdrawing the work would result in continued
deterioration of the building. While ongoing maintenance would
still be required, key fire safety recommendations would remain
unaddressed, exposing the Council to potential legal non-compliance
with statutory obligations, including:
·
Landlord and Tenant
Act 1985
·
Homes (Fitness for
Human Habitation) Act 2018
·
Housing Act 2004
(HHSRS)
·
Regulatory Reform
(Fire Safety) Order 2005
·
Building Safety Act
2022
·
Fire Safety (England)
Regulations 2022
·
Decent Homes
Standard
Partial or Reduced Scope: Undertaking works in phases
risks non-compliance with health and safety legislation and
increases overall costs due to site set ups, welfare, other
contractor prelims, and management costs. A full package of works
offers greater cost efficiency.
