Recommendations:

1.1 To note the evidence relating
to problems being caused by poorly managed HMOs and privately
rented accommodation in as described the Islington PRS Housing
Stock Condition and Stressors Report in appendix 8

1.2 To note the evidence for
consulting people who may be affected by a designation under
sections 56 and s80 Housing Act in Appendix 7

1.3 To note the outcome of the
consultation set out appendix 1

1.4 To note the council’s
response to the consultation set out in appendix 2

1.5 To exercise its powers under
s56 Housing Act 2004 and designate the borough of Islington as an
area subject to additional licensing of the following types of
HMOs: • houses and flats occupied by three or four persons who
are not members of the same family and who share kitchen and/or
bathroom facilities • buildings converted into two or more
flats where the conversion does not comply with the appropriate
building standards (those applied in 1991 or later) where all the
flats are privately rented and in single ownership

1.6 To exercise its powers under
s80 Housing Act 2004 and designate the following wards within the
London Borough of Islington as an area subject to
selective

licensing: Barnsbury, Caledonian,
Tufnell Park, Mildmay, Highbury, Junction, and Laycock as indicated
in the map in Appendix 5

1.7 To note that in response to
consultation further detailed work is being undertaken about the
general conditions specified in section 80(6) Housing Act 2004
within Canonbury and Clerkenwell wards.

1.8 To agree the proposed property
licence conditions in appendix 3 that landlords would be required
to adhere to as part of the schemes and delegate authority to the
Corporate Director for Homes and Neighbourhoods, following
consultation with Executive Member for Homes and Neighbourhoods, to
periodically review licence conditions and determine any change for
the duration of the additional HMO licensing and selective
schemes.

1.9 To agree the licence fee
structure as set out at Appendix 4 of the report and delegate
authority to the Corporate Director for Homes and Neighbourhoods,
following consultation with Executive Member for Homes and
Neighbourhoods, to periodically review the fee structure and
determine any change for the duration of the additional HMO
licensing and selective schemes.
