1. Award Stage – The decision to award and sign the contract.
Decision
The Lead Member has AGREED to:
- Approve the award of the contract for the provision of Council Homes External Cyclical Works known as Tranche 2 Lot 7 Properties collectively known as Campden House to Milestone Contracting Limited (Company No 15352836) in the sum £5,513,114.23 ex. VAT (£6,615,737.08 inc. VAT) for a period of 62 weeks from the anticipated commencement date around September 2026.
- Approve the establishment of a project contingency sum, as outlined in exempt Appendix 1, that may be required for additional works that may become necessary and which are in scope of the contract’s variation provisions or other unanticipated costs, with spend against the contingency to be approved by officers within the delegations set out in Housing Management’s Scheme of Delegation.
- Delegate authority to the Director of Housing Management to approve under Contract Regulations any variations to the contract that are out of scope of the contract’s variation provisions (irrespective of whether there is contingency available)
- Delegate authority to the Director of Housing Management to approve additional project costs in any instances of unforeseen works or services that result in costs over and above the contract award sum and the project contingency sum. In such cases, a Delegated Authority Decision (DAD) report will be prepared for approval by the Director of Housing Management with legal and financial implications.
- Acknowledge that the Section 20 consultation for Leaseholders under Landlord and Tenant Act 1985 will be completed following this award decision and that in the event this is not satisfactorily concluded, a further report will be submitted to the Lead Member.
- Approve, following consultation with the Executive Director of Environment and Neighbourhoods the endorsement of a waiver to depart from the Council’s Contract Regulations, as prior approval was not sought for the changed procurement strategy to undertake the tender exercise due to risks around cost uncertainty under Lot 4 of the Project Union Framework (previously Lot 3), as per sections 14 and 15 the plus Table 2 Waiver Requirements of the Part 8, Section 5 Council Contract Regulations, on the grounds set out in Section 1.2 of the report.
